<br />Case #4: <br /> <br />Adoption of Rural Developing Interim Ordinance; Case of City of Ramsey <br /> <br />Community Development Director Trudgeon reviewed that at the March 28, 2006 meeting, the <br />Council introduced a proposed interim ordinance that would place a one-year moratorium on <br />platting and subdividing land in the R-l Rural Developing Zoning District. The ordinance is <br />now eligible for adoption. Mr. Trudgeon read into the record a letter received by Ronald J. <br />Tallman of the Wild Oaks of Ramsey, dated April 11, 2006, regarding the proposed ordinance in <br />relation to Wild Oaks of Ramsey, a l3 lot development on 36.37 acres in northern Ramsey. The <br />letter states if the Council is voting to push back Wild Oaks of Ramsey they wish to apply for a <br />waiver of moratorium and continue with their development as planned. <br /> <br />Councilmember Cook stated this development is a perfect example of what the cluster ordinance <br />can do. The remainder of land will go into a land trust for the City to protect the land behind this <br />property. <br /> <br />Councilmember Elvig requested clarification that there is no action pending on the Wild Oaks of <br />Ramsey development. <br /> <br />Community Development Director Trudgeon replied that is correct. He advised in order to <br />address the possibility of a parcel within the R-l Rural Developing Zoning District having its <br />land use changed to allow for City sewer and water to serve the parcel, staff has added language <br />to this ordinance that would allow for the subdivision of parcels that receive a land use change <br />through an approved Comprehensive Plan amendment approved by the City Council and <br />Metropolitan Council. <br /> <br />City Attorney Goodrich advised the moratorium is proposed for a term of one year. The <br />moratorium can be repealed at any time by the City Council if the work is complete. <br /> <br />Mayor Gamec commented he has not heard anyone on the Council that is opposed to the cluster <br />development. The concern is to address things such as greenways and protecting certain areas. <br />He noted the Shade Tree development brought up the problems of dealing with this type of <br />development. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Cook, to adopt Ordinance #06- <br />07 to establish an interim moratorium ordinance in the R-l Rural Developing Zoning District,for <br />a nine-month period to provide time for the City to study development within the Rural <br />Developing area and the cluster subdivision ordinance. <br /> <br />Further discussion: Jim Maloney, Civil Engineer working with Wild Oaks of Ramsey <br />Development, stated as Mr. Tallman's letter covered, Wild Oaks of Ramsey has been in this <br />process under the ordinance as it is currently written, and has gone through the sketch plan, the <br />preliminary plat process, and through all the hoops in working towards final approval. Wild <br />Oaks of Ramsey is at a stage where what remains to yet be approved in their development is the <br />final septic design, which is essentially being completed this week. He requested the Council to <br />consider the waiver of moratorium in regards to this development where they have truly tried to <br /> <br />City Council / April 11, 2006 <br />Page 14 of 26 <br />
