meet the vision of what the City is looking at. Councilmember Cook suggested the applicant
look to Section 4 and apply under undue hardship exemptions. Community Development
Director Trudgeon explained this development has been tabled at the Planning Commission for
lack of information, and is scheduled for the May Planning Commission meeting, followed by
the May 9th City Council meeting. The 120 day timeframe is an issue and a determination will
need to be made at the May 9th Council meeting. Councilmember Elvig stated he appreciates
where Wild Oaks of Ramsey is coming from, but the Council cannot move forward with
anything on this development without information to consider. He stated some mistakes were
made and things came to light regarding the cluster ordinance. The Council has a sincere intent
to make a very good ordinance out of the cluster ordinance. They do not want to create the same
problems north of Trott Brook as there are south of Trott Brook. The cluster ordinance is the
right tool, but it has not been honed properly. Councilmember Cook stated the moratorium
includes an educational process. His phone number and email are on the City's web page, and
residents can contact him to discuss the ordinance.

A roll call vote was performed by the Recording Secretary:

Mayor Gamec:
Councilmember Cook:
Councilmember Elvig:
Councilmember Jeffrey:
Councilmember Olson:
Councilmember Pearson:
Councilmember Strommen:

aye
aye
aye
absent
aye
aye
aye

Motion carried.

Councilmember Elvig left the meeting at 8:55 p.m.

Case #5:

Request for Vacation of Easements in the Proposed Plat of Brookfield First
Addition; Case of Oakwood Land Development

Community Development Director Trudgeon stated the plat of Brookfield eliminates the need for
Marble Street N.W. and 16ih Avenue N.W., adjacent to Lot l, Block 1, Westby First Addition.
The plat of Brookfield also replats Lot l, Block 1, Westby First Addition and eliminates the need
for the standard drainage and utility easements along the property lines of that lot. Council
granted final plat approval to Brookfield First Addition on March 14, 2006 contingent on
approval of the requests for easement vacation. The City Council introduced the ordinance to
vacate the pertinent easements at the March 28, 2006 Council meeting. The ordinance is now
eligible for adoption.

Motion by Councilmember Pearson, seconded by Councilmember Strommen, to adopt
Ordinance #06-08 to vacate the drainage and utility easements on Lot 1, Block 1, Westby First
Addition.

A roll call vote was performed by the Recording Secretary:

City Council / April 11, 2006
