CASE # p2,, RECONSIDER RECOMMENDATION REGARDING COUNCIL-MANAGER FORM OF GOVERNMENT By: William K. Goodrich, City Attorney - Background: The Charter Commission members will recall- that at your meeting on December 5, 2006, you recommended that the City Council adopt an ordinance to change the City's form of government from the Mayor-Council form to the Council-Manager form. The Commission's recommendation included that the change be effective January 1, 2008. The City Council met on December 28, 2006, and was unable to pass the Charter Commission's recommendation unanimously as required by State. law. The City Council did, however, pass a substitute ordinance unanimously which would have an effective date of January 1, 2011. The issue is now back before the Charter Commission for you to reconsider. If the Charter Commission will recommend the Charter amendment ordinance having an effective date of January 1, 2011, the amendment will have passed, subject to the public's right to petition for a referendum on the ordinance. If the Charter Commission does not recommend the amendment ordinance with the January 1, 2011 effective date, .the amendment will fail as it cannot pass without a favorable Charter Commission recommendation. The Charter Commission, of course, is able to make any other recommendation to the City Council, however, this will necessitate starting the process over..
