CASE # p2,, <br />RECONSIDER RECOMMENDATION REGARDING <br />COUNCIL-MANAGER FORM OF GOVERNMENT <br />By: William K. Goodrich, City Attorney <br />- Background: <br />The Charter Commission members will recall- that at your meeting on December 5, 2006, you <br />recommended that the City Council adopt an ordinance to change the City's form of government <br />from the Mayor-Council form to the Council-Manager form. <br />The Commission's recommendation included that the change be effective January 1, 2008. The <br />City Council met on December 28, 2006, and was unable to pass the Charter Commission's <br />recommendation unanimously as required by State. law. The City Council did, however, pass a <br />substitute ordinance unanimously which would have an effective date of January 1, 2011. <br />The issue is now back before the Charter Commission for you to reconsider. If the Charter <br />Commission will recommend the Charter amendment ordinance having an effective date of <br />January 1, 2011, the amendment will have passed, subject to the public's right to petition for a <br />referendum on the ordinance. <br />If the Charter Commission does not recommend the amendment ordinance with the January 1, <br />2011 effective date, .the amendment will fail as it cannot pass without a favorable Charter <br />Commission recommendation.
