CASE # <br />PUBLIC BEARING TO <br />CONSIDER ADOPTION OF AN ORDINANCE <br />TO AMEND CITY CHARTER SECTION 2.1 <br />By: James E. Norman, City Administrator <br />William K. Goodrich, City Attorney <br />Background: <br />The Charter. Commission met on December 5, 2006 to consider an amendment_ to the Charter. The <br />amendment would change section 2. I of the Charter and provide that the City be governed ~by the <br />Council-Manager Form of Government. Currently, the City is governed by the Mayor-Council <br />Plan. The City Administrator and City Clerk have available materials from the League of Cities <br />explaining the. differences between the two plans and will be able to provide the material to you <br />upon request. <br />At its December 5th meeting the Charter Commission recommended that the City Council enact an <br />ordinance to amend the Charter as above stated." Please note that the Charter Commission <br />recommends that the amendment be effective January. I, 2008. The City Council does not have the <br />authority to change that date. Enclosed is a draft of the ordinance recommended. The procedure for <br />amending the ordinance is prescribed by State Statute and it generally is as follows: <br />(1) The Charter Commission recommends the amendment by ordinance to the City <br />Council. <br />(2) Prior to final ordinance enactment, the Council must hold a public hearing upon two <br />week's published notice. <br />(3) The ordinance requires the affirmative vote of alI Councilmembers to be adopted. <br />(4) The ordinance is not effective unti190 days after passage and publication. <br />(5) Within 60 days after passage and publication of the ordinance, a petition requesting <br />a referendum on the ordinance can be filed with the City Clerk. If a petition is filed, . <br />- I will advise on the procedure after the petition filing. \ <br />The Council introduced. the recommended Ordinance on December 12, 2006.
