<br />outlined in the LRRWMO plans. Local plan amendments must be forwarded to each <br />organization affected by the amendment for review and approval before adoption. <br /> <br />12. Submittal and Review. Upon completion of the "Final Draft Plan" that has been approved <br />by staff and Council, the report will be forwarded to the LRRWMO and all other agencies for <br />review according to Minnesota Statutes, secti9n I03B.235. The consultant will assist the City <br />with responses to comments that are returned regarding the plan review, and make appropriate <br />revisions. Once the final revisions are made and approved the final product (20 copies) shall be <br />submitted to the City. The final plan document shall also be submitted in an electronic format <br />compatible with Microsoft Word 2003. The consultant will submit the final approved plan to the <br />necessary organizations. <br /> <br />All recommended improvements are to be in English units. <br /> <br />V. RESOURCES AVAILABLE FROM THE CITY <br /> <br />. Hard copy maps and as-builts. A hard copy of the existing Comprehensive Storm Drainage Plan and <br />addendums. <br />. Aerial and CAD topographic information dated 2003. <br />. GIS based drainage area map <br />. Existing Comprehensive Land Use Plan adopted December 2001 in printed format. <br />. FEMA' s flood plain maps. <br />. The Comprehensive Plans and Policies for the LRRWMO in printed format. <br />. Any ArcView GIS maps that the City has will be available in digital or printed format. <br />. Miscellaneous water resources reports and agreements in printed format. <br /> <br />VI. CONTRACT TERMS <br /> <br />No reimbursement will be made by the City of Ramsey for any costs incurred preparing and presenting <br />the proposals, or other work done prior to an agreement being executed and receipt of a formal notice to <br />proceed. The City of Ramsey expects to utilize an hourly rate contract with a maximum dollar (not to <br />.exceed) amount that the City will pay to the successful Consultant on a monthly basis, with a final <br />payment due at the completion of Consultant's duties under the Agreement entered into between the <br />parties. The hourly rates shall include all labor costs, labor additives, general and administrative costs, <br />reimbursables, materials and profit. Subsequent contracts; if any, mayor may not use this contracting <br />approach. <br /> <br />It is anticipated that monthly estimates will be used as method of payment with the Consultant submitting <br />a detailed invoice listing times, personnel, mileage, etc. chargeable for that period and status of work. <br /> <br />A. Independent Consultant <br /> <br />It is agreed that nothing herein contained is intended or should be construed in any manner as <br />creating or establishing the relationship of copartners between the parties hereto or as constituting the <br />Consultant's staff as the agents, representatives or employees of the City for any purpose in any <br />manner whatsoever. The Consultant and its staff are to be and shall remain an independent <br />Consultant with respect to all services performed under this proposal. The Consultant represents that <br />it has, or will secure at its own expense, all personnel required in performing services under this <br />proposal. Any and all personnel of the Consultant, subcontractors or other persons, while engaged in <br />the performance of any work or services required by the Consultant under this proposal, shall have <br /> <br />6 <br /> <br />25 <br />
