<br />months for the City and Metropolitan Council to review and approve said Comprehensive Plan <br />Amendment and Zoning Amendment. <br /> <br />SECTION 3. STUDIES <br /> <br />The City Council, by Resolution #06-03-101, has authorized City Staff to further study the Rural <br />Developing area in order to identify those sections of City Code Section 9.20.11 which need to be <br />modified to better implement said City Code section. The City Council has further directed City <br />Staff to prepare a Zoning Amendment and a Comprehensive Plan Amendment for consideration by <br />the Planning Commission and City Council. <br /> <br />SECTION 4. PROHIBITION <br /> <br />During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Zoning <br />and Subdivision of Land", no subdivision or platting of any land shall be permitted and no <br />applications for said subdivision or platting shall be accepted for the R-l Rural Developing Zoning <br />District, as defined by the City's Official Zoning Map, revised February 28,2006. Notwithstanding <br />the above prohibition of subdivision or platting of any land in the R-l Rural Developing Zoning <br />District, any parcel of land in the R-l Rural Developing Zoning District that becomes eligible to <br />receive City sewer and water utilities through approval of a Comprehensive Plan amendment <br />approved by the City Council and Metropolitan Council may subdivide or plat land in accordance <br />with applicable City Code provisions. <br /> <br />SECTION 5. UNDUE HARDSHIP EXCEPTIONS <br /> <br />The City Council may grant an exception to the provisions of this Ordinance when, in its opinion, <br />undue hardship may result form strict compliance. In granting an exception, the City Council shall <br />prescribe any conditions that it deems necessary to or desirable for the protection of the public <br />interest. NO exception shall be granted unless the City Council finds: <br /> <br />1. That there are special circumstances or conditions affecting said property such that <br />the strict application of the provisions of this Interim Ordinance would deprive the <br />petitioner of the reasonable use of petitioner's land. <br /> <br />2. That the exception is necessary for the preservation and enjoyment of a substantial <br />property right of the petitioner. <br /> <br />3. That the granting of the exception will not be detrimental to the public welfare or <br />injurious to other property in the area in which the property is situated. <br /> <br />4. That the proposed exception will be harmonious with and in accordance with the <br />specific objectives of the City's existing Comprehensive Plan and will not adversely <br />affect the planning process for adoption of amendments to the Comprehensive Plan <br />above described. <br /> <br />5. That the proposed use/subdivision will be consistent with the intent and purpose of <br />this Ordinance. <br />
