<br />Exhibit 3 <br /> <br />I. Reforestation/Restitution Requirement. If a development exceeds <br />the allowable removal threshold specified above, the subdivider shall <br />either reforest appropriate areas within the site (or outside the site if <br />appropriate locations within the site are not available), pay restitution, <br />or some combination thereof. <br /> <br />1. For each one (1) tree inch that is removed beyond the threshold, <br />the subdivider shall replant one and one-quarter (1.25) inches of <br />new trees or pay the City a set fee per caliper inch as established <br />by City Council. or some combination thereof. <br /> <br />2. If there is insufficient area within the site to plant the required <br />replacement trees or landscaping, they may be planted within any <br />park. open space, or boulevard within the city, as determined by <br />the City and provided the City consents in writing. The City may <br />also elect to receive cash in lieu of trees on a fee per caliper inch as <br />established by City Council. <br /> <br />3. Restitution shall be paid to the City in cash prior to the City's <br />release of the signed final plat mylars for recording. Any <br />restitution paid shall be placed in the Community Tree Fund and <br />shall be used for reforestation proiects and tree maintenance. <br /> <br />m. Tree Inches Exempted. The tree inches of significant trees to be <br />removed for water quality treatment ponds, required public trails or <br />sidewalks, and rights-of-way for arterial and collector roadways shall <br />be exempt from the calculation of total significant tree inches on a <br />development site. <br /> <br />SECTION 3 SUMMARY <br /> <br />The following official summary of Ordinance #07-_ has been approved by the City <br />Council of the City of Ramsey as clearly informing the public of the intent and effect of <br />the Ordinance. <br /> <br />It is the intent and effect of Ordinance #07-_ to amend Ramsey City Code Chapter 9 <br />(Zoning and Subdivision of Land) Section 9.24.04 (Private Trees in New Development <br />Areas) to: <br />. Require tree preservation plans for multi-family and commercial developments to <br />include a tally of total significant tree inches on a site and the percentage of total <br />significant tree inches to remain on a site after development. <br />. To require that at least forty percent (40%) of the inches of significant trees <br />remain on site after multi-family development projects and at least twenty percent <br />(20%) of the inches of significant trees remain on site after commercial <br />development projects. <br />
