<br />Ciry of ~... <br />RAMSEY <br /> <br />CITY NEWSLETTER NOVEMBER/DECEMBER 2002, VOLUME 17, No.6 <br /> <br />RAMSEY CHARTER QUESTIONS FOR <br />NOVEMBER 5TH ELECTION VOTE <br /> <br />The Ramsey Charter Commission has directed that a question <br />pertaining to Section 3.2 of the City's Charter appear on the ballot as <br />follows: <br /> <br />Ql: Should the Home Rule Charter of the City of Ramsey be <br />amended to delete Section 3.2 "Liaison Function" and <br />subsection 3.2.1 "Precinct Liaison"? <br /> <br />The original City Charter contained the Liaison Function Section, <br />which requires Councilmembers to act as a liaison for each of the City's <br />then three precincts. The City now has eight precincts. The City now has <br />established a ward system, which divides the City into four wards with <br />each ward electing its own Councilmember. The precinct liaison and the <br />ward Councilmember have similar functions with respect to listening to <br />citizens concerns. <br />The Ramsey Charter Commission has also directed that a question <br />of whether or not to repeal Chapter 14 of the City Charter, entitled <br />Metropolitan Urban Service Area, appear on the ballot as follows: <br /> <br />Q2. Should the Home Rule Charter of the City of Ramsey be <br />amended to delete Chapter 14 of the Charter, which Chapter <br />is titled "Metropolitan Urban Service Area?" <br /> <br />Section 14.1 was adopted at a special City election on August 15, <br />1995. Section 14.2 was adopted at a special City election on September <br />22, 1997. Chapter 14 generally relates to land use issues and specifically <br />(i) Section 14.1 addresses how the City is to modify its Metropolitan Urban <br />Service Area (MUSA) line. The MUSA is the area within the City, which <br />is served by municipal sewer and water; (ii) Section 14.2 addresses <br />community development standards relating to residential real property <br />density and traffic generation analysis. <br />Since its adoption, the City Council has requested legal opinions <br />on the legality of Chapter 14. These legal opinions have concluded that the <br />process of addressing land use issues in a Charter is not lawful and not <br />permitted under Minnesota law. The primary basis for these conclusions is <br />that Minnesota State law has pre-empted such Charter provisions.
