WHEREAS; some utility companies have noted that they may have facilities partially <br />located in the affected area. <br /> <br />FINDINGS OF FACT <br /> <br />1. That the right-of-way vacation will not violate the intent and purpose of the <br />Comprehensive Plan. <br /> <br />nd <br />2. That the right-of-way vacation is necessary to accommodate the plat of Ace 2 Addition. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the Ramsey City Council hereby grants the vacation of the right-of-way for Basalt <br />Street Northwest as follows: <br /> <br />nd <br />a. All that part of Basalt Street NW embraced within Lot 1, Block 1, Ace 2 Addition, <br />according to the recorded plat thereof, Anoka County, Minnesota (see Exhibit A). <br /> <br />2) That the Applicant must work with any affected utility companies to relocate those <br />facilities at the Applicant’s expense. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Olson, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Heineman <br /> Councilmember Riley <br /> Councilmember Olson <br /> Councilmember Buscher <br /> Councilmember Peters <br /> Councilmember Specht <br /> Councilmember Stewart <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />and the following were absent: <br /> <br /> None <br /> <br /> <br />Resolution #26-096 <br />Page 2 of 3 <br />
