<br />Consensus of the Committee was to direct staff to determine whether City Attorney Goodrich has <br />the ability to act on behalf of the City as a realtorlbroker, to refine the numbers included in the <br />cost estimates, to proceed with the traffic analysis, and to present the information to Council for <br />direction as quickly as possible. <br /> <br />Chairperson Elvig directed staff to determine the status of properties in the City where first right <br />of refusals have been directed to be negotiated. <br /> <br />Case #3: <br /> <br />Request for Quit Claim of Remnant Parcel of City Property <br /> <br />City Engineer Jankowski stated on December 21,2006 the City received a letter from Mr. James <br />Provinzino the owner of the property at 6304 Highway 10 requesting that the City quit claim to <br />him a 2,022 square foot parcel which is located between his property and Riverdale Drive. A <br />copy of Mr. Provinzino's letter and a map illustrating the general area of the subject parcel are <br />included in the Committee's packet. Mr. Jankowski explained when Riverdale Drive was <br />constructed in 1989 the land acquired by the City created a number of small remnant parcels of <br />land on the north side of the 80 foot wide right-of-way. Sanitary sewer and water utilities are <br />located in Riverdale Drive. Mr. Provinzino's letter refers to parcel2A which is 1,815 square feet. <br />This parcel was quit claimed to Blue Line Collision so that Blue Line Collision would have legal <br />access to the municipal utilities as well as ingress and egress to Riverdale Drive. Mr. Provinzino <br />is requesting that Parcel 1A which is 2,022 square feet be similarly quit claim to him for the <br />same reasons. Included in the packet is the information on this parcel provided by Anoka <br />County. Mr. Jankowski advised Parcel Bl was quit claimed to Mr. Rick Haugland (Blue Line <br />Collision) on June 6,2001 with the City retaining drainage and utility easements over the parcel. <br />The costs of preparing the quit claim deed and associated fees were to be paid by the grantee. <br /> <br />City Engineer Jankowski advised staff recommends that this parcel be quit claimed to the <br />adjacent property owner contingent upon the grantee preparing a quit claim deed which retains <br />drainage and utility and trail easements in favor of the City over the subject parcel, and that the <br />grantee be responsible for all legal review and recording costs. Once the quit claim deed is <br />prepared an ordinance will need to be passed for the property to be disposed by the City. <br /> <br />Chairperson Elvig asked if this quit claim is something the City typically charges for, and <br />whether this parcel would be gifted. <br /> <br />City Engineer Jankowski when Riverdale Drive was constructed in 1989 the City obtained a <br />number of parcels to facilitate that. The right-of-way was obtained for Riverdale Drive and the <br />title was kept on the severed pieces, which is these three parcels. <br /> <br />Chairperson Elvig questioned if it is the opinion of staff that this is of no value, and the only <br />value is potential easements. He commented on the benefits of this property to someone that has <br />to exit onto Highway 10 and can now exit onto a side road. <br /> <br />City Engineer Jankowski noted the County has the land valued at $1,000. <br /> <br />Public Works Committee / January 16, 2007 <br />Page 8 of 13 <br />
