9.13 Soils <br /> <br />9.13.01 <br /> <br />Purposes and Findings <br /> <br /> Subdivision 1. The City determines that in areas not served by sanitary <br />sewer, the effluent fi'om septic tanks shall be disposed of by soil absorption in properly <br />constructed and effectively operating absorption systems. <br /> <br /> Subd. 2. The City determines that protection of the public health, safety <br />and general welfare, including the protection of natural resources from irnpain'nent, <br />pollution, and destruction, with which it is charged by Minnesota Statute 1973, <br />§Ii6B.01, are advanced by permitting soil absorption systems only where soil <br />permeability, surface slope, fi'eedom from flooding and distance fi'om groundwater <br />ensure reasonable absorption without pollution of waters, such lands hereinafter being <br />described as Class I lands. <br /> <br /> Subd, 3, The City finds that lands within it have un£avorable <br />characteristics ~'or soil absorption systems; such lands hereinafter being described as <br />Class ii, IIi, IV and V lands. <br /> <br /> Subd. 4. The City adopts the standard requirement that sufficient area of <br />Class I land be available within each lot or parcel for the construction of an adequately <br />sized' soil absorption system and the reconstruction or duplication of the soil absorption' <br />or final disposal unit of that system. In no case shall the area of contiguous Class I land <br />available on each lot be less than as follows: <br /> <br />a. 2000 Urb~'n Area 50% of lot area <br />b. Transitional Area 25% of lot area <br />c. Rural Area 25% of lot area <br /> <br />All areas shall be exclusive of public rights of way, including publicly dedicated <br />easements: All required areas of contiguous Class ~ land availability may include that <br />portion of the lot or parcel used for building construction and all such areas may include <br />building set-back requirements, except that there must be adequate area for septic <br />construction in the 2000 Urban Development Area and adequate area for septic tank <br />construction in the 2000 Urban Development Area and adequate area for septic tank <br />construction and reconstruction in the Trm~sitional-and Rural Development Areas. <br /> <br /> Subd. 5. Tine City adopts the Anoka County Soil Survey,..1977 (Soil <br />Survey) and supplemental operational soil surveys as its official soil sm'vey and makes it <br />a part of this City Code, a copy of which is on file with the Administrator. The soil <br />survey is a guide to establishing land classifications as defined herein. Land areas <br />mapped and described in the soil survey as being acceptable for soil absorption systems <br />does not constitute an implied or express warranty that such iand is in fact usable for this <br />purpose. <br /> <br />9-108 <br /> 405 <br /> <br /> <br />
