Mayor Gamec requested that the City Engineer study the issue and report back to the Council. <br />Thc issue is what is going to laappen along Highway #10 and how long are they going to wait. <br /> <br />Councilmember Strommen requested that staff get more information f'rom the Departrnent of <br />Health and tile MPCA so they could weigh the public health issue over the convenience issue <br />before the two parties negotiate any of the issues. <br /> <br />Councilmember Zimmerman stated ti'tat they need to take into consideration the rights of' tile <br />property owners at the time they applied. <br /> <br />Mayor Oamec stated that he thought the City was requiring, as part of fine rewrite of Chapter 9 of <br />the City Code, that sewer and water has to be extended to the property line. <br /> <br />Community Development Director Frolik replied that the developers of Sunfish Commons were <br />under that requireme~t, but it was waived by the City Council to come in conjunction with the <br />l"rontage road. <br /> <br />City Attorney ©oodricln noted that he disagrees with the interpretation of the development <br />agreement as stated by the manager of Sunfish Commons. He explained that the City would <br />have a very compelling argnment because in the development agreement it states tlnat the <br />developer shall cause the watermain to be extended to the property line. If fi'tings char~ge and the <br />City does not require the fl'ontage road to be constructed the developer would still be required to <br />extend the services to the property line. <br /> <br />Motion by Conncilmember Kurak, seconded by Councilmember Strommen, to direct staff to <br />consider the Council discussion pertaining to the extension of sewer and water to Oak Terrace <br />Esta res regarding timing an d health issues. <br /> <br />Further discussion: Coullcilmember Kurak stated that public safety, lnealth and welfare should be <br />tlneir top priority. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councih-nembers Kurak, Strommen, Cook, <br />Elvig, Pearson, and Zimmerman. Voting No: None. <br /> <br />Case #2: Lions Picnic/Application for a One-Day, 3.2 Malt Liquor License <br /> <br />Mayor Gamec stated that the Ramsey Lions are again applying for a one-day, 3.2 percent malt <br />liquor license for the Community Picnic that is scheduled for Saturclay, Jnne 7, 2003, at Central <br />Park. The Lions have provided all of the necessary documents required for issuance of this type <br />of license. Under City Code, it is a permissible activity to grant a 3.2 percent malt liquor license <br />to the Ramsey Lions Club tbr this event. As has been done in the past, City staff requested that <br />the Council waive the license fee.
