128 <br /> <br /> Nonconforming Use - Illegal - A building, structure, premise, or use which at <br />the time of its establishment did not comply or conform with the applicable conditions or <br />provisions of the City Code which were in effect at such date, and which continues such <br />noncompliance and nonconformance with the present City Code. <br /> <br /> Nonconforming Use - Legal - A building, structure, premise, or use which at the <br />time of its establishment was in compliance and conformance with the applicable conditions and <br />provisions of the City Code which were in effect at such date, but which does not now comply or <br />conform to conditions and provisions of the current City Code. <br /> <br /> Normal (Ordinary) High Water Mark - A continuous mark of reference at an <br />elevation where land and water meet for some period of record; is commonly that point where <br />the natural vegetation changes fi.om predominantly aquatic to predominantly terrestrial. <br /> <br /> Nursing Home, Rest Home or Convalescent Home - A building having <br />accommodations where care is provided for two or more invalids, infirmed, aged, convalescent, <br />or physically disabled persons that are not of the immediate family; but not including hospitals, <br />clinics, sanitariums or similar institutions. <br /> <br /> Off-street Loading Space - A space accessible from the street, alley or way, in a <br />building or on the lot for the use of trucks while loading or unloading merchandise or materials. <br />Such space shall be of such size as to accommodate one truck of the type typically used in the <br />particular business and shall be exclusive of general public and employee parking spaces. <br /> <br /> Open Sales Lot - Any open land used or occupied for the purpose of buying <br />selling and/or renting merchandise and for the storing of same prior to sale. <br /> <br /> Operable Motor Vehicle - A vehicle that can be presented in a self-propelled <br />condition within seven (7) days of the City's request for such action. <br /> <br /> Outlot - A parcel that is not a developable piece of property unless re-platted in <br />accordance with Cit3, ordinances. <br /> <br /> Parking Node - A parking area with 2 or more parking spaces that are usually for <br />common parking in medium and high density developments.
