9.14.08 Height Limitation on Landfill Activity. The height of. a landfill <br />becomes a scenic blight and nuisance when the landfill activity rises above any natural or <br />man made screening. Therefore, landfills may not exceed the height of the lowest berm, <br />barrier or vegetation surrounding the landfill site. <br /> <br />9.14.09 Required Practices for Maintenance and Operation and Landfills. <br />Solid waste landfills shall be operated and maintained in accordance with the rules <br />promulgated by the commissioner of the MPCA and in compliance with Section V of <br />Anoka County Ordinance 83-3 as may be amended from time to time except as modified <br />or amended herein. <br /> <br /> Subdivision 1. Visual screening shall be accomplished as provided in <br />Subsections 7 and 8 of this City Code. <br /> <br /> Subd. 2. A minimum separation distance of 1,000 feet is required <br />between a residence and where landfill construction activity is proposed to take place. <br /> <br /> Subd. 3. No solid waste disposal facility shall be opened for use and shall <br />not receive solid waste deposits before 7:00 a.m. or after 6:00 p.m. Monday through <br />Friday and before 7:00 a.m. or after 2:00 p.m. on Saturdays. No operations are permitted <br />on Sundays. No equipment operation shall commence before 6:30 a.m. or continue <br />longer than one hour after the daily closing time of the landfill as herein specified. All <br />solid waste deposits shall be covered within these time limits on the day received. <br /> <br />9.14.10 Time Limitation. No conditional use permits or permit renewals for a <br />solid waste disposal facility shall be granted for a period exceeding five (5) years from <br />the date of issuance of the initial Conditional Use Permit. The applicant shall agree to the <br />limitations provided in this Section by contract duly executed by authorized <br />representatives of the applicant in a form satisfactory to the Council. <br /> <br />9.14.11 Criteria for Landfills. Land disposal facilities shall be located, designed <br />and operated in such a way as to prevent any adverse impact upon adjacent land uses. In <br />addition to the criteria listed in {}9.03.04 of the City Code, the following criteria shall be <br />considered when evaluating a request for a conditional use permit for landfills. <br /> <br /> Subdivision 1. Whether the proposed landfill will be in compliance with <br />the Anoka County Solid Waste Management Master Plan, Metropolitan Council's <br />Guide/Policy Plan and MPCA rules. <br /> <br /> Subd. 2. Whether the proposed landfill is accessible year-round by nine <br />(9)-ton or greater weight-bearing roadways that have adequate capacity to accommodate <br />landfill generated traffic. <br /> <br /> Subd. 3.
