P44 <br /> <br />Case//2: <br /> <br />Request for Vacation of Easements in Wildlife Sanctuary 2''a Addition; Case <br />of Oakwood Land Development, Inc. <br /> <br />Public Hearin~ <br /> <br />Mayor Gamec called the public hearing to order at 7:24 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that the City Council rccently approved the plat <br />of Wildlife Sanctuary 2nd Addition. Wildlife 2nd is a replat of Lots 1, 2 and 3 of Wildlife <br />Sanctuary Addition into 54 urban single-family lots. Each of the 3' pre-existing lots in Wildlife <br />Sanctuary contained the standard drainage and utility easements around the perimeter. With the <br />replat of the property, all 54 lots were designed with the standard drainage and utility easements <br />around the perimete?. These easements dedicated around the perimeter of the 54 new lots <br />conflict with the easements dedicated when the plat consisted of only 3 lots. The process of <br />replatting does not vacate any pre-existing easements of record. The only way to eliminate <br />easements of record is by City Council ordinance. City staff recommended introduction of the <br />ordinance to vacate pre-existing easements in Wildlife Sanctuary. <br /> <br />Citizen input <br /> <br />Patrick Hampton, 15551 Potassium Street NW, Ramsey, stated that he wanted to see what they <br />are planning on doing and how it impacts his property. <br /> <br />Community Development Director Frolik explained that the plat had already been approved by <br />the Council, and it includes 54 lots. <br /> <br />b/tr. Hampton stated that he wants to make sure that whatever they do does not impact his <br />property. <br /> <br />Councilmember Cook stated that the development has already received approval. At this time, <br />they are only looking at vacating easements that are no longer necessary. <br /> <br />Mayor Gamec explained to Mr. Hampton that the City makes sure that drainage from a new <br />development stays on the property being developed. <br /> <br />Mr. Hampton inquired if the Met Council was forcing the City to develop the high density. <br /> <br />Mayor Gamec replied no. <br /> <br />Mr. Hampton stated that he believes in property rights, but he did not see the need for developing <br />high density on a small parcel because it will become a ghetto. <br /> <br />City Council/March 25, 2003 <br /> Page 6 of 16 <br /> <br /> <br />
