Subdivision I. Purpose. The purpose of conditional rezonina is to formalize <br /> development standards to ensure consistency and compatibility with surroundina land <br /> uses and neighborhoods. <br /> <br /> Subd. 2. Procedure. The procedure fbr chan~ng zoning district boundaries <br />(rezonin~) shall be as follows: <br /> <br />Execution of a Conditional Rezonin2 A~,n-eement (,cRA") recorded with the <br />subject property shall be compulsory, tbr all' rezonin~s to multiple family <br />commercial, and/or industrial districts, includinz the.foltowtnz: <br /> <br />R-2 Medium DensiW Residential District <br /> <br />R-3 Hi~-h Density Residential District <br /> <br />B- 1 General Business DistriCt <br />B-2 Highway Business Distict <br />E- 1 Employment District <br />E-2 Employment District <br />P Public Facilities District <br />PUD Planned Unit Development District <br /> <br />Subd. 3. Standards: The fi)llowin,2 shall be included in the CRA: <br /> <br /> a. A~eement to layout, develop and maintain the subiect property as presented <br /> in the accompanying prelim/naD' plat or site plan. ' <br /> <br />Provision to allow the City Council to commence r'ezonint~ of the subject <br />property to the previous zoning district it' the preliminaW plat or site plan is <br />not adhered to. Said zonin~ chan~e shall not be contested by the subject <br /> <br />property owner or parties to CRA. <br /> <br /> c. Additional standards may be included to protect the health, safety; and general <br /> welihre of surroundine land uses. <br /> <br /> Subd. 3. Modifications. Any modification or revision to the CICh or attached <br />plan shall' be prohibited without consent of the City Council. Any Substantial. modification as <br />determined bv the Citw Council shall be subject to a public hearing and notification 0f adjacent <br />property owners pursuant to the public hemfng requirements of this Chapter. <br /> <br />9.03.054 Conditional Use Permits <br /> <br /> Subdivision 1. Purpose. The purpose of this SectiOn is to provide the City <br />with a reasonable degree of discretion in determining the suitability of certain designated uses <br />upon the general welfare, public health, and safety. A conditional use is a use which, because of <br />certain characteristics, cannot be properly classified as a permitted use in the zoning district <br />within which it is proposed.
