If the development is not progressing reasonably well, according to schedule, <br /> the owner may be required to submit a statement to the Zoning Administrator setting <br /> forth the reasons forthe lack of progress. If the Council finds that the development has <br /> not occurred according to the established development schedule or is not otherwise <br /> reasonable in the view of the Council, the Council .may..revoke the Conditional Use <br /> Permit and all development shall cease until' a revised 'Schedule is approved. <br /> <br />Ownership. Application for a P.U.D. may be made only by the owner of the land <br />'involved in the application, or by .his duly authorized representative, except that a <br />long-term option or contract holder may apply, provided his application, is accompanied <br />by fully executed agreements or documents from the owner stating that he has no <br />objections and is joining in the same as his interest may appear. The applicant must <br />furnish with the Preliminary Plat one (1) copy of an up-to-date certified abstract of title, <br />registered property report, or other evidence as the City Attorney may require showing <br />title or control by the applicant or other consenting owners. <br /> <br />(6) <br /> <br />(7) <br /> <br />(8) <br /> <br />Withdrawal. Any application for a P.U.D. may be withdrawn by the applicant at any <br />time prior to filing the required Final Plat thereof as required in the Subdivision <br />Regulations or at any time during the approval process. ' <br /> <br />Park Fees. Park Fees will apply to'all newly created developable lots. -Fees to be based <br />on most current park fees / dedication chart adopted by the City Council. <br /> <br />Miscellaneous. Signs, parking facilities and any other provisions not specifically <br />discussed in this P.U.D. section shall be regulated by regulations contained elsewhere <br />in this Chapter or other applicable ordinances, laws, or regulations. <br /> <br />(9) <br /> <br />Transition to Future Development Plan. Prior to any further development within an <br />approved P.U.D., the following actions must occur: <br />a. Sanitary sewer and municipal water service be available to the property. <br />b. An-amended P.U.D. development plan be approved by the City Council. <br />c. A development agreement be completed between the City and all required <br /> parties, which among other conditions, requires the existing residential dwellings <br /> to be connected to sewer and water when .they become available. <br /> <br />Section 2.
