CASE # <br /> <br /> PUBLIC HEARING <br /> REQUEST FOR AN INTERIM USE PERMIT TO.ALLOW <br />OUTDOOR STORAGE OF COMMERICAL VEHICLES AND EQUIPMENT ON A <br />RESIDENTIALLY ZONED PARCEL;, <br /> CASE OF GERALD BAUER- <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />The City received a complaint in November of 2002, reporting that Able Paving & C0nstmction was <br />storing their commercial vehicles and equipment and possibly operating a branch office on the <br />property located at 16130 Variolite Street, also known as the St. Anthony Gun Club property. <br /> <br />Gerry Bauer is the owner of the subject property, which is now called Ramsey Shooting Center. Staff <br />contacted Mr. Bauer on November 14, 2002 stating that the Ramsey Shooting Center is a legal non- <br />conforming use, however additional commercial activity on the subject property would be a violation <br />of City Code. <br /> <br />Mr. Bauer contacted City Staff and stated he is leasing a portion of the subject property tO Able <br />Paving & Construction, who is utilizing the property for outside storage of their commercial vehicles <br />and equipment. Mr. Bauer is requesting an interim use permit to allow for outside storage of <br />commercial vehicles and equipment on the subject property for approximately a 2-year period. <br /> <br />The following items are enclosed for your review: <br /> <br />a) Site location map <br />b) Pictures of the Subject Property <br />c) Letter from staffdated November 14, 2002 <br />d) Proposed Findings of Fact <br />e) Proposed Interim Use Permit <br /> <br />Notification: <br /> <br />In accordance with State statute, Staff notified property owners within 350 feet of the subject <br />property of the public hearing. <br /> <br />Observations: <br /> <br />The subject property is zoned R-1 Residential and City Code does not permit commercial activities- <br />as a principal use. in a residential district. As previously stated, the gun club is a legal non- <br />conforming use and therefore commercial activities on the subject property cannot be expanded <br />without the property being rezoned to business or the property owner receiving a conditional use <br />permit for commercial expansion. <br /> <br /> <br />
