City Code states that in a residential district, outside storage of commercial vehicles and equipment <br />is permitted as an accessory use provided the following criteria can be maintained: 1) All vehicles <br />and equipment must be parked in the side or rear yard 2) Must be screened to a degree of 75%, 100% <br />of the time while unattended 2) All commercial vehicles and equipment located within the MUSA <br />boundary must be parked on a concrete or bituminous pad and if the property is located outside of <br />the MUSA boundary the commercial items must be parked on a minimum of Class V. <br /> <br />Able Paving & Construction is utilizing the property for outside storage of a bobcat, 2 rollers, 3 <br />trailers, 5 dump trucks, 1 truck, and a paving machine. They also perform mechanical work within an <br />existing accessory structure and they periodically bring clean excess construction/paving products <br />(i.e. sand and gravel) to the site. Able Paving arrives.to the subject property to utilize the vehicles <br />and equipment around 6:00am and typically return to the site around 6:00pm. Currently the items are <br />being stored on a combination of grass and gravel. <br /> <br />Staff conducted an-on-site inspection and found an array of commercial vehicles and equipment, <br />several 50-gallon drums filled with oil, and sand and gravel products on the site. Staff did notice that <br />Mr. Bauer has placed Able Paving & Construction in an area on the subject property that is <br />completely surrounded by mature trees. [t does not appear that any adjacent neighbors can visually <br />see the commercial vehicles and equipment. : <br /> <br />Recommendation: <br /> <br />[t is staff's opinion that the request to store commercial vehicles and equipment on the subject <br />property is not the most desirable use for the subject property. Staff is concerned with the 6:00am <br />time period employees would be coming to the site and the commercial nature of the business <br />increasing in activity during the summer months when construction is at its busiest time. Staff is also <br />concerned with mechanical work being performed on site and excess construction/paving products <br />being brought to the property. <br /> <br />Staff if recommending denial of the request. Staff is of the opinion that the surrounding residential <br />neighborhood could be negatively affected by the increase in traffic and commercial vehicle noise <br />that will be generated by the nature of Able Paving's business, especially during the busy <br />construction season. Staff is also concerned that if the City granted the interim use permit allowing <br />just outdoor storage of vehicles and equipment and did not permit mechanical work on site or <br />product to be brought to the site, the opportunity for Able Paving & Construction to perform a quick <br />mechanical fix or store some excess product just overnight is greatly increased. <br /> <br />Commission Action: <br /> <br />Motion to adopt Resolution #03~02- Findings of Fact # relating to. a request from Gerry <br />Bauer for an interim use permit to allow for commercial outside storage on a residentially'zoned <br />parcel. <br /> <br />-and- <br /> <br /> I <br /> i <br /> I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br />I <br />i <br />I <br /> <br /> <br />
