CASE # <br />REQUEST FOR AN INTERIM USE PERMIT' TO ESTABLISH A MOTOR VEHICLE <br /> SALES LOT ON AN UNIMPROVED LOT; CASE OF E-Z AUTO SALES, INC. <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />Todd Bialon of E-Z Auto Sales, Inc. has submitted an application for an Interim Use Permit to allow <br />him to establish and operate his used car sales business, absent of the required site improvements, <br />at 7751 Hwy. #10 N.W., for an interim period of time. <br /> <br />The following items are enclosed for your review: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Grading, Drainage & Erosion Control Plan <br />Proposed Findings of Fact <br />Proposed Interim Use Permit <br /> <br />Notification: <br /> <br />State law requires notification to properties within 350 feet of the boundaries of the subject property <br />and property owners within that radius were notified. <br /> <br />Observations: <br /> <br />The subject property is approximately 2.7 acres in size and is zoned B-3 Highway Business. Motor <br />vehicle, implement and recreational equipment sales and rental are permitted uses in this district. <br />Outdoor display areas for items for sale or rent is an allowable accessory use in the B-3 Highway <br />Business District provide the display area is paved and the perimeter of the pavement is finished with <br />B612 concrete curbing. The customer and employee areas must also be paved and curbed. One off- <br />street parking space is required for every 10 vehicles on display. <br /> <br />Mr. Bialon desires to establish his motor vehicle sales bUsiness on the subject property. However, <br />the property lacks the required pavement and curbing, and the Weather is no longer conducive to <br />installing bituminous pavement. Mr. Bialon has submitted an application for an interim use permit <br />to enable him to conduct business on the property without the required site improvements until <br />December 31, 2003. Mr. Bialon has engaged the services of John Oliver and Associates to prepare <br />a Grading, Drainage and Erosion Control Plan that identifies a 2-phase site improvement plan. Mr. <br />Bialon has proposed that the western half of the subject property will be paved and curbed by June <br />30, 2003 and the eastern half will be completed by December 31, 2003. The plan submitted <br />proposes 140 vehicle display spaces; City Code requir.es 14 customer/employee parking Spaces for <br />a 140 unit display area The grading plan identifies 26 customer/employee parking spaces located <br />west and north of the building. <br /> <br />The City Engineer has reviewed the Grading, Drainage and Erosion Control Plan. The 1.3 acres of <br />current pavement and rooftop is drained from the south to the north over the parldng lot into three <br />catch basins located along the northern curbline of the parking lot. These catch basins discharge into <br />two unconnected detention basins. The overflow from the western basin will overflow into the TH <br />I 0 drainage ditch system. The discharge from the eastern basin will discharge to the Burlington <br />Northern and Sante Fe railroad drainage system. <br /> <br /> <br />
