2 A permit for this site has been issued to Mr. Bialon by the Lower Rum River Water Management Organization, which has reviewed the adequacy of the stormwater retention ponding. City Staff review notes that the western half of the site has an overland grade across the parking area which exceeds one percent. However, overland flows across the eastern parking area has grades of 0.5% and flatter. It is unlikely that bituminous can be graded flatter than one percent without resulting in "bird baths" being left in'the finished pavement. Staff recommends extending catch basins to the center of the eastern parking area or adding additional catch basins to increase the grade of the overland surface. The Grading, Drainage and Erosion Control plan should be modified accordingly. Recommendation: City Staff recommends approval of the request for an interim use permit. The permit is drafted to require Mr. Bialon to place a financial sure~y with the City ensuring that the required site improvements will be installed as proposed. Commission Action: Motion to recomm~end that City Council adopt Findings of Fact relating to a requeSt from Todd Bialon for an Interim Use Permit to operate a motor vehicle sales lot, without the required site improvements, for an interim period of time. Motion to recommend that City Council approve Mr. Todd Bialon's request for an Interim Use Permit to operate a motor vehicle sales lot at 7751 Hwy. #10 N.W. without the required site improvements, for an interim period of time, and adopt a resolution declaring the terms of the permit. -or- Motion to recommend that City Council deny Mr. Bialon's request for an Interim Use Permit to operate a motor vehicle sales lot at 7751 Hwy. #10 N.W. without the required site improvements, based on the findings of fact.
