52 <br /> <br />three larger, rural lots on the west that are also zoned R-1 Residential, located within the MUSA <br />and eligible for redevelopment at urban standards. The new density transition ordinance does not <br />clearly state what the requirements would be, if any, in situations where the adjacent property is <br />in the MUSA, zoned the same as the developing parcel, but currently consists of the larger, rural <br />type lots. <br /> <br />Jotm Peterson, Oakwood Land Development, stated that he has been working with the existing <br />four homeowners on the site and has entered into a. purchase agreement with each of them. In <br />addition he has met with all of the property owners to the west of the proposed development. <br />The first property is a rental property, the second parcel is five acres with a pretty significant <br />boundary, the th/rd property owner has Iived on the property for many years. Each of the <br />homeowners has seen the plan and they all understand the potential of their own property being <br />developed in the future. He did not want to speak for those homeowners, but he did feel they <br />understood the development potential. He noted that the only issue with the larger parcel is that <br />it was used to raise elk and so it contains a ten-foot tall fence along a substantial distance of the <br />property. One resident has asked that they extend that fence and he has told them that 'they <br />could. Mr. Peterson stated that the natural screening that exists on the property tums out to be <br />perfect. He presented pictures of the property and inventory of how many trees, that would serve <br />as a screen on each of the lots. He also stated that he would be willing to place restrictive <br />covenants on the property so that none of the buffering trees could be disturbed. <br /> <br />Councilmember Kurak inquired as to how many of the trees pictures were on hi's property. <br /> <br />Mr. Peterson replied that all of the trees he included in the inventory p~;esented to the Council are <br />on his land. He noted that there are additional trees on the adjacent parcels. <br /> <br />Councilmember Hendriksen inquired if the residents were aware of the meeting since part of <br />their decision should be based on hearing from the residents. <br /> <br />Mr. Peterson replied that he was not asking for a decision from the Council at tonight's meeting, <br />He was only looking for an informal discussion. He noted that all of the residents are aware that <br />there will be a public hearing. <br /> <br />Councilmember Hendriksen inquired if staff notified any of the residents of this meeting. <br /> <br />COmmunity Development Director Frolik replied no, because there will be a public hearing. <br /> <br />Mr. Peterson stated that each of the property owners understand that brining sewer and water to <br />their property will increase the value of'their properties, but .he does not want to put any words in <br />their mouths. He would like them to have the opportunity to speak.at the public hearing. <br /> <br />Councilmember Hendriksen stated that he thinks residents shoUld be heard on what they want <br />and be able to make an informed decision.
