Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #26-160A A RESOLUTION APPROVING AN ONSITE WASTEWATER TREATMENT SYSTEM COMPLIANCE AGREEMENT BETWEEN THE CITY OF RAMSEY AND VOICE OF HOPE CHURCH FOR PROPERTY LOCATED AT 15620 ARMSTRONG BOULEVARD WHEREAS Voice of Hope Church owns property located at 15620 Armstrong Boulevard NW, Ramsey, Minnesota, legally described as Lot 1, Block 1, Voice of Hope Church Addition, subject to easements of record, which is served by an Onsite Wastewater Treatment System (OWTS); and WHEREAS, the City of Ramsey is responsible for the administration and enforcement of Minnesota Rules Chapters 7080 through 7083 and applicable City ordinances governing onsite wastewater treatment systems; and WHEREAS, the septic system designer and licensed installer have determined that the site does not have sufficient area to accommodate the septic tank capacity that would otherwise be required utilizing the standard design flow criteria established under Minnesota Rules Chapter 7081.0130; and WHEREAS, the proposed Onsite Wastewater Treatment System Compliance Agreement establishes procedures for monitoring water usage over a three-month period utilizing the City water meter, evaluating the measured flows, requiring system improvements if necessary, and requiring reevaluation of the wastewater treatment system should the use or occupancy of the property change in the future NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. The Onsite Wastewater Treatment System Compliance Agreement between the City of Ramsey and Voice of Hope Church for the property located at 15620 Armstrong Boulevard NW is hereby approved in substantially the form presented to the City Council. 2. The Mayor and City Administrator are authorized and directed to execute the Agreement on behalf of the City of Ramsey. 3. City staff are authorized to administer and enforce the terms of the Agreement, including review of the flow monitoring data, determination of compliance, and implementation of any actions required under the Agreement and applicable Minnesota Rules. 4. Voice of Hope is required to record the agreement at the Anoka County Office of Recorders/Registrar of Titles. The motion for adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same:
