barricade across both ends of the project. If the fencing would be authorized through a change <br />order, the fencing could be anticipated to be in place by mid September. If the fencing is to be <br />competitively bid and installed subsequent to an additional contract and additional month can be <br />anticipated over the change order schedule date. Staff recommended that the contractor be <br />directed to open the roadway as soon as final roadway improvements are completed, and that <br />additional signing and construction fencing be installed and maintained until the permanent <br />fencing is in place. Additional costs associated with this measure should be itemized and billed <br />outside the contract. These costs should be paid for by RLK, Inc. <br /> <br />Councilmember Hendriksen inquired if there were any legal reasons that they should not go <br />ahead with a change order. <br /> <br />Director of Public Works/Fire Chief Kapler replied no, along as it falls within the parameters of <br />the contract. <br /> <br />Councilmember Kurak inquired if there is a certain time frame that the road needs to be open. <br /> <br />City Engineer Jankowski replied no, but noted that staff has received calls from residents <br />inquiring when the road will be opened. <br /> <br />Councilmember Kurak stated that she did not feel comfortable with allowing people to use the <br />road without the fence being in place. If that can be accomplished by mid-September she did not <br />see any reason to open the road any sooner. <br /> <br />Mayor Gamec stated that he would like to have the road open once everything is completed. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to direct staff to bring to the next <br />City Council meeting the change order with costs and the proper funding sources so that the road <br />can be completed by the end of September. <br /> <br />Motion carried. Voting Yes: Mayor Gamec and Councilmembers Kurak, Anderson, and <br />Hendriksen. Voting No: None. <br /> <br />Councihnember Hendriksen stated that he would like some comment from the City Attorney <br />regarding RLK's responsibility. He stated that if the City is hiring an engineering firm to do the <br />engineering and significant things are being missed there is something wrong. <br /> <br />Director of Public Works/Fire Chief Kapler replied that staff will meet with the City Attorney to <br />discuss the issue m~d then staff will report back to the Council. <br /> <br />Councilmember Kurak inquired if bidders submitted bids off the same specifications. <br /> <br />City Engineer Jankowski replied yes. <br /> <br />Public Works Committee/August 21, 2001 <br /> Page 4 of 11 <br /> <br /> <br />
