Mr. Preston replied that it would probably become a frontage road leaving only one pair of lanes. <br /> <br />Councihnember Kurak inquired as to how out in the future they should expect the changes to <br />occur and how is the City suppose to be planning for future development along Highway #10. <br /> <br />Mr. Preston replied that if the City can agree with MnDOT on the location of the freeway then <br />the City can start the necessary planning, but the project probably would not be completed for at <br />least 20 years unless more funding becomes available. <br /> <br />Councihnember Kurak inquired as to who would be responsible for eliminating the businesses <br />the currently exists. <br /> <br />Mr. Preston replied that there are several options to handle that situation. One option would be <br />that anyone having a building in the corridor when it came time to acquire the land would be paid <br />fair market value, but anyone who chooses to erect a building once the corridor has been <br />identified would only be paid for the building. <br /> <br />Councilmember Kurak inquired as to whom would be responsible for acquiring the property. <br /> <br />Mr. Issacson replied that he did not know the answer to that question at this time. Typically <br />when projects to this magnitude happen things get negotiated. <br /> <br />Mayor Gamec inquired if right of way funds could be used for land acquisition if the plan is <br />agreed to. <br /> <br />Frank Athco, MnDOT, replied that there are many mechanisms available. He explained that <br />right of way acquisition funds could be used by the City to purchase land and then MnDOT <br />would purchase the land from the City. At this point they are just starting the visioning process, <br />but would still have to go through the environmental process before they could begin the process <br />of reserving right of way funds. <br /> <br />Mr. Preston explained that the Official Map Law allows a community, once a city and MnDOT <br />have agreed to a corridor plan, to reserve the necessary and the businesses could be there until it <br />came time to acquire the land, but if land is bare ground when it is officially mapped anyone who <br />chose to build would do so at their own risk. <br /> <br />Councihnember Hendriksen requested that staff receive more information regarding the Official <br />Map Law for the next Public Works Committee meeting. <br /> <br />Councihnember Kurak stated that if there is a valuable piece of property along Highway #10 that <br />is vacant the City would be taking away the value of the land. <br /> <br />Councilmember Zimmerman inquired if an interchange near the railroad tracks would be more <br />expensive. <br /> <br />Public Works Committee/November 20, 2001 <br /> Page 9 of 13 <br /> <br /> <br />
