<br />CASE # 1 <br /> <br />REPORT FROM PUBLIC WORKS <br />By: Public Works Staff <br /> <br />Background: <br /> <br />The Public Works Committee met on Tuesday, February 20, 2007 and discussed the following <br />four cases: <br /> <br />CITIZEN INPUT <br /> <br />None <br /> <br />Case #1 <br /> <br />Consider Request for Placement of Monument Sign in Street ROW <br /> <br />Background: <br /> <br />In November of 2006, Oakwood Land Development submitted a sign permit application for an <br />entrance/monument sign for the Brookfield Subdivision. The proposed location of the sign is in <br />the center median on 170th Ave NW, the main entrance to the development off of Nowthen Blvd, <br />which falls within the public road right-of-way. The sign permit has not been issued because <br />currently, City Code does not allow signs to be placed or constructed within the public road <br />right-of-way. <br /> <br />The City Attorney has recommended against permitting a sign in the right-of-way due to the <br />potential liability, which would ensue if the sign is deemed to be the cause of personal injury or <br />property damage by persons using the roadway and/or right of way. Planning Staff believe that <br />the sign design and placement would enhance the entrance to. the development. The sign <br />ordinance indicates that a conditional use permit is required to deviate from the sign regulations. <br />The City would have an opportunity to specify certain required conditions if Oakwood Land <br />Development intends to pursue a conditional.use permit. <br /> <br />Mayor Gamec suggested that the COmnllttee recommend the issuance of the conditional use <br />permit, that any damage to the sign is the responsibility of the homeowners association or the <br />developer, that the conditional use permit should be issued along with the sign permit with a plan <br />showing the location of the sign far enough back so that there is a good site line both north and <br />south on Highway 5, and that the City would have no responsibility or liability involved in any <br />damage to the sign, or any liability in regards to the placement of the sign. <br /> <br />Action: <br /> <br />No action required. <br /> <br />-153- <br />
