<br />uncertain if a distracted driver (talking on a cell phone, dealing with children, etc) were to <br />approach this intersection. <br /> <br />Recommendation: <br /> <br />The City Attorney has recommended against permitting a sign in the right~of-way due to <br />the potential liability which would ensue if the sign is deemed to be the cause of personal <br />injury or property damage by persons using the roadway and/or right of way. While <br />Planning Staff believe that the sign design and placement would enhance the entrance to <br />the development, there remain unanswered questions and potential concerns with <br />permitting a sign in the public road right-of-way. <br /> <br />The sign ordinance indicates that a conditional use permit is required to deviate from the <br />sign regulations.
