<br />Clean-up. Diamonds must make sure clean-up of right-of-ways and adjacent properties, <br />including the pond, are completed within 24 to 48 hours of the end of the event. Mr. Gruber has <br />put $1,000 in escrow toward clean-up. If clean-up help is needed from the City, and the amount <br />is more than what's in escrow, the extra will be billed to Diamonds. If there is a balance in the <br />account after clean-up assistance, that will be refunded to Mr. Gruber. If clean-up is done <br />satisfactorily without assistance from City crews, the entire escrow will be refunded. <br /> <br />Charge for Permit. The rates and charges state that fees for special events will be calculated on a <br />case-by-case basis and that the Council will determine those fees. Mr. Gruber has stated this <br />event is a fundraiser for families of troops in Iraq and he is proposing to donate 10% of the gross <br />food and beverage sales only to the families of the troops in Iraq. Currently City Code does not <br />set a minimum donation in order to qualify for the waiving. of the fees as a fundraiser. Staff <br />points out that the charitable gambling portion of the City Code requires 75% of its lawful <br />purpose expenditures be conducted or located within the City's trade area and to benefit such <br />area. City Council may wish to discuss a minimum donation percentage amount that would <br />qualify an event as a fundraiser and ~thus possibly allow the waiving of the permit fees or for the <br />fees to be set at a lower rate. Staff will seek direction from Council with regard to what fees <br />should be charged for this permit. <br /> <br />Staff sent a letter to Mr. Gruber outlining what is being talked about in the case and what Mr. <br />Gruber will need to supply to City staff prior to his case being heard.
