<br />for the tent, taking into account the noise impacts. Mr. Gruber explained the set up of the tent is <br />being dictated by the State of Minnesota. The tent is required to be attached to the fence so the <br />gate is the only access; the direction of the tent will go towards the river. He and Chief Way are <br />working on an exit procedure to get people out safely. Police Chief Way recommended the <br />motion state that final approval of the application will be worked out by staff to allow them to <br />finish the application. The application shows 12:00 a.m. on both nights, and will be changed to <br />reflect what has been discussed tonight. Also, on Saturday night if the officers do not feel two <br />can safely handle the situation if the crowd gets larger, he would like to be able to have an officer <br />request additional help. He does not want to be caught in a situation where they need to request <br />help from other cities. He explained this could be addressed without calling an officer in from <br />their day off by calling in officers that start at 10:30 p.m. early and holding over officers that are <br />finished at 11 :00 p.m. Councilmember Elvig stated public safety is in the hands of the Police <br />Department, and they would have authorization for whatever is needed to assure that. <br /> <br />The motion on the floor was amended as follows: <br /> <br />To approve the special events permit for Diamonds Sports Bar & Grille, for an outdoor concert, <br />plus other events, at 7550 Highway #10 NW, for Friday and Saturday, May 18 & 19,2007, with <br />the music to end at 11 :00 p.m. on Friday and midnight on Saturday. The midnight time frame on <br />Saturday should be conducted as a test case with the Police Department to observe from 10:30 <br />p.m. to midnight with the information brought back to the Council to understand the results of <br />the midnight. timeframe. The standard fee is to be charged for the permit, staff is given <br />authorization for final approval of the application, and security needs are authorized at the <br />discretion of the police officers. <br /> <br />Further discussion: Councilmember Strommen indicated the policy issue of music times for <br />outdoor events should come back to Council at a worksession with findings from this case. <br />Police Chief Way noted the policy discussion should also address midweek hours. <br />Councilmember Look inquired about the possibility of officers volunteering for this type of <br />fundraising duty. Police Chief Way explained officers are not allowed to wear a uniform unless <br />they are being paid, and there would also be issues with the union contract. There are any <br />number of issues that could occur if there were to be off duty officers present in uniform. <br />Councilmember Elvig noted the County's 150th anniversary celebration will be occurring this <br />same weekend. He suggested the Police Department may want to consider what other type of <br />events will be occurring in the community so there is plenty of staff on hand. <br /> <br />Motion carried. Voting Yes: Councilmembers Elvig, Jeffrey, Dehen, Look, Olson, and <br />Strommen.
