<br />Councilmember Elvig stated he has been considering this. He appreciates the things Mr. Gruber <br />does for the City, but what puts him on his heels is when the request comes before the Council <br />and it is now their fault for not allowing it. He would ask in the future that Diamonds would get <br />in front of that. He thinks the Council likes the event and exposing Ramsey to the surrounding <br />areas. He is of the opinion to let this happen at midnight, but does not want to create a <br />precedent. He would suggest allowing the music until midnight as a test study with a review of <br />the calls that come in. It would be good to tell the community what this is about. He <br />understands people go to bars late, and this is an activity that starts late. Diamonds is not in a <br />strong neighborhood area. Being in the tent makes a big difference to him, and the music will <br />only go until 11 :00 on Friday night. He would suggest the later time on Saturday be used as a <br />test case with the police to observe from 10:30 p.m. to midnight on Saturday, and that the <br />information be brought back to the Council to understand the results of the midnight timeframe. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to approve the special <br />events permit for Diamonds Sports Bar & Grille, for an outdoor concert, plus other events, at <br />7550 Highway #10 NW, for Friday and Saturday, May 18 & 19,2007, with the music to end at <br />11 :00 p.m. on Friday and midnight on Saturday. The midnight timeframe on Saturday should be <br />conducted as a test case with the Police Department to observe from 10:30 p.m. to midnight with <br />the information brought back to the Council to understand the results of the midnight timeframe. <br /> <br />Further discussion: Councilmember Jeffrey stated it makes a difference to him that the midnight <br />time would be for one night. He voted against the motion at the previous Council meeting <br />because it only addressed weekends and did not look at the rest of the week. He stated he agrees <br />Diamonds has done a great job of running events in the past, and he would hope in the future <br />Council would have a chance to receive information before these types of requests. <br />Councilmember Dehen stated he made his point at the last meeting; this is a one time event. He <br />would be in favor of the midnight time on Saturday and 11 :00 p.m. on Friday. Councilmember <br />Strommen stated she agreed with Mayor Gamec at the last meeting that 11 :00 is a responsible <br />time, and she still agrees with that. It is difficult to say this is a special event. It is a worthwhile <br />cause, but when Lord of Life comes in to promote an event for its youth, that is a great event too. <br />The motion to conduct a test case with the later time on Saturday night could be used in creating <br />a policy on outdoor music during the week and on weekends, with findings used to specifically <br />craft the policy. She would go along with that on this one case, with it made clear that it will be <br />a test case. She would not want to start picking and choosing worthy causes. Councilmember <br />Look stated they should also take into account the location of Diamonds being on Highway 10 as <br />compared to Lord of Life Church which is in an area with houses. Also, the music will be inside <br />the tent. It will be important to advertise to the people about the event and let them know it will <br />be going on until midnight. Councilmember Elvig noted staff should provide a recommendation <br />on the permit fee, which is usually based on costs and staff time. Mayor Gamec asked if there is <br />a fee in place for outdoor entertainment events. Mr. Gruber indicated the fee for the outdoor <br />event Diamonds did two years ago was $300. They put $1,000 down, the permit fee was $300, <br />and there was a police fee; they were reimbursed the difference. Interim City Administrator <br />Nelson explained the escrow is used to charge against clean up costs. The permit fee Mr. Gruber <br />referred to was for the special outdoor event. Staff will confirm the fees with Mr. Gruber <br />tomorrow. Councilmember Elvig indicated the language included in the motion should include <br />the standard fee for the permit.
