Motion by Board Member Bawden and seconded by Board Member Anderson to accept #1 <br />through #13 as presented. <br /> <br />Further discussion: Board Member Anderson inquired whether the dry sprinkler system is <br />required by Code. Mr. Rova affirmed that it is required along with regulations regarding draft <br />stops every 9000 feet, and they have decided to provide draft stops spaced at less than 100 feet. <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Bawden, Anderson, Jensen, <br />Terry, and Wivoda. Voting No: None. Absent: Board Member LaDue. <br /> <br />Motion by Chairperson Deemer and seconded by Board Member Jensen to amend #14 to read <br />"That the special conditions causing the undue hardship, restrictions based on fire suppression <br />reach capabilities, do result from the actions of the Applicant." <br /> <br />Further discussion: Chairperson Deemer stated the applicant has chosen not to build this <br />structure with a flat roof when such an option would avoid the need for a variance. <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Jensen, Anderson, and <br />Terry. Voting No: Board Members Bawden and Wivoda. Absent: Board Member LaDue. <br /> <br />Commissioner Jensen noted she was looking for a Finding regarding fire protection. <br /> <br />Mr. Kapler stated that the rescue of occupants is within the fire department's capabilities. <br />Having a fiat roof would make no difference for rescue, however better control of the fire could <br />be achieved with an aerial truck. Elk River, Andover, and Anoka have aerial ladder trucks, and <br />therefore, have higher capabilities than Ramsey. <br /> <br />Community Development Director Sherman discussed the high buildings in downtown <br />Minneapolis/St. Paul and the fact that they must use varying techniques to control fires and <br />provide safety. <br /> <br />Board Member Anderson implored speeding up the purchase of an aerial truck as the City <br />continues to grow. It would be unfortunate to stump the City's growth due to lack of this <br />equipment. <br /> <br />Consensus of the Board of Adjustment was to recommend expediting the purchase of an aerial <br />truck. <br /> <br />Mr. Kapler stressed the need to look at each individual building to consider all aspects including <br />safety. Silos, antennas, etc. are examples of unique considerations. <br /> <br />Chairperson Deemer noted that Courts no longer consider "hardship," but "practical difficulty." <br /> <br />Motion by Chairperson Deemer and seconded by Board Member Anderson to amend #15 to read <br />"That if denied, the Community will be deprived of constructing a facility that will help achieve <br />the City's life-cycle housing goals under the Livable Communities Act at this time." <br /> <br />Board of Adjustment/September 10, 1998 <br /> Page 3 of 4 <br /> <br /> <br />
