<br />Mr, W'!lz slated the City is requiring extreme expenses with this project. The extension of l56th <br />A venue- is being required at their expense, as well as the expansion of the City sewer and water . <br />system, while the utilities will not likely be in use for 5 to 10 years, <br /> <br />CounciImember Cook indicated at the very least an easement should be retained to allow for a <br />trail or sidewalk in the future, <br /> <br />Councilmember Elvig concurred. <br /> <br />Mr. Walz commented the easement would be on City property, <br /> <br />Councilmember Strommen expressed. her agreement with the statement made that there would <br />not be any trails in the City if they did not start at SOIne point. She expressed concern regarding <br />how to ~w the line on this requirement and the effect on future connections. <br /> <br />Councilmember Cook stated under most conditions he would likely agree with Councilmember <br />Strommen, but when a trail is required it is uslJBliy on the applicant's property or it is a present <br />transportation route where the developer is required to put the trail in beyond their park and trail <br />dedication. In this case the location of the trail is City property and park dedication is being <br />required, If the City wants to put the trail iri dowu the line it could be done with park dedication <br />funds, which this developer is paying. <br /> <br />Mr. wali questioned where the trail would go, as it is adjacent to Northern Burlington Railroed's <br />property and borders the City of Elk River, . <br /> <br />Councilmember Cook replied the City has put in trails that go to the City's borders and are <br />continued with cooperation from adjoining cities. This trail is likely a x:egional thought, and the <br />City has discussions with. different communities to work things out ina regional way. He agrees <br />the developer is p'aying park dedication, and he would- be wiling to make sure there is an <br />easement to make the trail connection some day. <br /> <br />Mayor Gamec noted the trail actL).a.lly lines up with a park in Elk River. <br /> <br />Consensus of the Council was _ to require the developer to provide an easement for a future trail, <br />rather than constructing a sidewalk as required in the Staff Review Letter. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to edopt Final Plat <br />Resolution #06-12-406 approving the Final Plat for Northfork Office Condos, with the exception <br />of the requirement for construction of sidewalk along 156!b Avenue, and authorizing staff the <br />flexibility to require the developer to provide a trail easement, contingent upon compliance with <br />the City Staff Review Letter, specifically addressing the following items: <br />1. Submit a revised grading and utility plan that is satisfactory to the Engineering <br />Department <br />2. Produce a copy of a utility operating agreement b~tween EcoCheck and the developer <br />3. A viable community septic system and well being constructed to meet the demands for all <br />15 buildings . <br />4.
