<br />CASE # J <br /> <br />Public Hearing- <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW omDOOR SALE, <br />DISPLAY,AND RENTAL AS A PRINCIl'AL USE: <br />CASE OF BROTHERS PROPERTIES <br />By: Breanne Daines, Associate Planner <br /> <br />Background: <br /> <br />Brothers Properties has submitted an application for a Conditional Use Permit (CUP) to allow <br />outdoor sale, display, and rental of equipment in the B-1 District. Brothers Properties is proposing to <br />lease their property to Rain For Rent, a company that rents equipment for construction services. <br /> <br />The following items are enclosed for your review: <br /> <br />a) Site location map <br />b) Site drawing <br />c) Aerials of other Rain for Rent locations <br />d) Proposed resolution for Findings of Fact <br />e) Proposed resolution to approve conditional use permit <br /> <br />Notification: <br /> <br />In accordance v.rith State Statute, the City attempted to notify property owners within 350 feet of the <br />Subject Property of the public hearing. <br /> <br />Observations: <br /> <br />On March 13, 2007 the City received an application from Brothers Properties for a CUP to use the <br />property for outdoor sale, display, and rental. The property located at 6300 Bunker Lake Boulevard is <br />zoned E-I Employment, and a CUP is required for the requested use. The property is 2.5 acres in <br />size, and based on the amount of outdoor display proposed, it is determined to be a principal use of <br />the property. <br /> <br />Rain for Rent, a company that rents and sells equipment to store large amounts of water for <br />construction projects, proposes to utilize approximately 20,000 square feet of the inside perimeter of <br />the property to store their equipment. This equipment will be stored on the property while it is not <br />being rented, and will be moved to and from the property regularly. This will require the use of <br />heavy loading vehicles. City Code allows open or outdoor services, sale, display, and rental as a <br />principal use, provided the following items are addressed: <br /> <br />I) The use does not take up parking space or loading areas requiredfor conformity to this <br />Chapter. <br />Although there is minimal existing parking area, the applicants propose to pave a <br />portion of their lot to accommodate customer and employee parking. Wbile the City <br />Code requiren1ent for open sales and display results in 22 parking spaces, Stafffeels <br />this is excessive and would require fewer spaces on the site, depending on the <br />number of employees and customers the tenant anticipates. <br /> <br />1 <br />
