Community Development Director Frolik indicated they have not addressed this in the City Code <br />yet. She advised variances are used for dimensional deviation, like building setbacks. But, you <br />have to prove a hardship based on some unique feature of the property. This would be difficult <br />to do in the case of building oversized garages. <br /> <br />Chairperson Nixt clarified that the City always uses a conditional use pmmit for this type of <br />request. <br /> <br />Community Development Director Frolik noted they are amending the variance guidelines to <br />also allow for practical difficulty and then variances may also be used for oversized garage <br />requests. <br /> <br />Motion by Commissioner Reeve, seconded by Commissioner Watson, to recommend that <br />Council adopt Findings of Fact relating to a request for a conditional use permit from Daryl and <br />Carol Richmond to exceed the size restriction for detached accessory buildings. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Reeve, Watson, and Brauer. <br />Voting No: Commissioner Van Scoy. Absent: Commissioners Johnson and Shepherd. <br /> <br />Motion by Commissioner Reeve, seconded by Commissioner Watson, to recommend approving <br />the issuance of a conditional use permit to exceed the accessory building size restriction based on <br />Findings of Fact and declaring terms of same. <br /> <br />Motion Carried. Absent: Commissioners Johnson and Shepherd. <br /> <br />Case #3 Request for Sketch Plan Review of the Ramsey Town Center; Case of <br /> Ramsey Town Center, LLC <br /> <br />Presentation <br /> <br />Principal Planner Trudgeon explained that the Comprehensive Plan, adopted in January 2002, <br />shows the area bounded by Ramsey Boulevard, Armstrong Boulevard and County Highway 116 <br />as being a mixed-use development. A development group, Ramsey Town Center, LLC has been <br />formed to develop approximately 369.5 acres as a mixed-use, pedestrian-friendly, transit-oriented <br />development known as the Ramsey Town Center. He advised the developers are doing an <br />AUAR 'for the area, in place of an EIS, but with guidelines that are as strict. He indicated the <br />AUAR was released April 8, and is out for the comment period. He advised the comment period <br />will be done in mid-May. He explained that from an environmental aspect; habitat; traffic; noise, <br />etc.; the AUAR provides a tool to look at all of those impacts in relation to the development. <br /> <br />Pete Keely, ESG Architects, indicated they have been working over several months with the <br />Town Center Task Force getting community input. He indicated the plan they are presenting to <br />the Planning Commission is similar to one of the first layouts, but they have tried to incorporate <br /> <br />Planning Commission/May 1, 2003 <br /> Page 4 of 17 <br /> <br /> <br />
