2) Update on signalization of Dysprosium/C.R. #116 Intersection <br /> <br />The County has determined warrants for signalization have been met for the intersection of <br />Dysprosium and C.R. #116. This intersection, along with others, will be reviewed by the <br />County. He has suggested the intersection of C.R. #57 and C.R. #116 also be studied for <br />signalization warrants in 1998. <br /> <br />3) Update on T.H. #47 Projects <br /> <br />Mr. Jankowski noted the City Attorney will proceed with acquisition of rights-of-way necessary <br />for the T.H. #47 project. The engineering consultants will be directed to proceed with their <br />plans. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to approve the <br />plan for the City Attorney to proceed with acquisition of rights-of-way necessary for the project <br />and directing the consultants to proceed with their plans. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Beahen, and Haas <br />Steffen. Voting No: None. <br /> <br />4) 1998 Street Maintenance Program <br /> <br />The 1998 Street Maintenance Program was reviewed at the Road and Bridge Committee. The <br />Program involves seal coating in a number of subdivisions throughout the City. Five projects <br />will be overlaid, one of which is 5.5 miles of MSA streets, including 167th Avenue and Ramsey <br />Boulevard, 153rd Avenue from C.R. #5 to Roanoke Street and 155th Avenue west of Ramsey <br />Boulevard. <br /> <br />Councilmember Haas Steffen stated that there was previous discussion about funding all of these <br />types of projects out of the general fund. She asked if this was done, could the developer's <br />escrow fees be used. <br /> <br />Mr. Goodrich stated in the past some escrow fees were applied and assessments were reduced. <br /> <br />Mayor Gamec stated the escrow goes to benefit the project that generated the escrow. <br /> <br />Mr. Goodrich stated there is an agreement written when escrow fees are paid. <br /> <br />Mr. Goodrich advised of a January 8, 1998 District Court judgment from Dakota County stating <br />the City of Eagan did not have to refund the impact fees, even though they had been determined <br />to be illegal, since the developers were not coerced into paying the fees to the City. Mr. <br />Goodrich stated similar situations have occurred in Ramsey. <br /> <br />Councilmember Zimmerman noted in new developments, no impact fees can be charged. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman, to direct the <br />City Engineer to prepare a feasibility study for the 1998 Street Maintenance Program. <br /> <br />City Council/January 27, 1998 <br /> Page 8 of 11 <br /> <br /> <br />
