Mr. Goodrich stated they would look at the clear language. <br /> <br />Mr. Hendriksen explained his intent of Section 14.1. He added that when the Planner presented <br />an update on the Comprehensive Plan process, it was stated that there were two plans and both <br />included an expansion of the MUSA. He stated that Council has a planner in their employ who <br />is talking about a MUSA expansion and Council has not yet taken a vote. He suggested, that <br />while Attorney Goodrich's opinion sounds like a defense attorney in that he's giving the opinion <br />Council wants him to have, an unbiased opinion would be that of the Attorney General. He <br />stated that Council has gone to the extraordinary effort to pass laws to overturn the Charter <br />amendments, it would behoove Council to take the time to get the Attorney General's opinion. <br />He suggested sending what Attorney Goodrich has written, along with his (Hendriksen's) <br />opinion. <br /> <br />Attorney Goodrich did not feel that this issue demands the Attorney General's opinion. <br /> <br />Motion by Councilmember Zimmerman to direct Attorney Goodrich to solicit a second opinion <br />from the Attorney General. <br /> <br />Motion died for lack of a second. <br /> <br />Councilmember Haas Steffen pointed out that it takes a long time to receive an opinion from the <br />Attorney General's office - maybe a year or more - and she did not want to wait that long. She <br />added that she is not interested in expanding the MUSA line at this time - it's premature to do <br />anything with the MUSA at this time. <br /> <br />Attorney Goodrich stated that the Attorney General's office may not even accept the question - <br />they will not give an opinion on every study. <br /> <br />Councilmember Haas Steffen suggested that if the legal research directed by Council shows that <br />it would be appropriate for the Attorney General to give an opinion on this issue, that Council <br />will be informed of that. <br /> <br />Case #3: Report from Personnel Committee <br /> <br />1) Consider Reappointments to City Commissions <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Haas Steffen to approve the <br />following reappointments: Planning Commission ~ Sharon Jensen and Michael Terry to terms to <br />expire 12/31/01; Park and Recreation Commission - Beth Asfahl, Reid Droegemueller, Steve <br />Ostrum and Michael Rolfe to terms to expire 10/31/01; and the Economic Development <br />Commission - David Kent, Harlan Anderson and Christopher Riley to terms to expire 1/31/02. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beyer, Haas Steffen, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />City Council/February 10, 1998 <br /> Page 7 of 9 <br /> <br /> <br />
