Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to schedule the <br />public hearing for the liquor license for Diamonds Sports Bar and Grill for 7:00 p.m., Tuesday, <br />March 10, 1998. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Beyer and Haas <br />Steffen. Voting No: None. Absent: CouncilmemberBeahen. <br /> <br />Consensus was that staff would bring information in writing from Fred Hoisington and Anoka <br />County to the March 10 Council meeting and, at that time, Council will direct staff to bring back <br />a resolution approving or denying the project. <br /> <br />Case #5: Introduce Right-of-Way Ordinance <br /> <br />City Engineer Jankowski stated that the purpose of a right-of-way ordinance is to regulate the use <br />of City right-of-way. This ordinance is based upon a model ordinance developed in cooperation <br />between the City Engineers Association of Minnesota and the League of Minnesota Cities. The <br />intended purpose of the model is to give cities a uniform set of regulations to help them govern <br />the use of their rights-of-way. It is intended to provide a single set of regulations that cities can <br />apply to all right-of-way users, including telecommunications companies. The ordinance <br />conforms to the provisions of the new telecommunications right-of-way legislation adopted into <br />law as Minnesota Session Laws 1997, Chapter 123. In particular, the ordinance implements a <br />city's attthority to manage its right-of-ways and to recover its actual costs incurred in managing <br />excavations and/or obstruction within the right-of-way. Mr. Jankowski pointed out that all the <br />issues were not resolved by the time the legislature adjourned, so the Public Utilities <br />Commission (PUC) was directed to establish a task force to draft rules and a model ordinance <br />relating to the placement of utilities in public rights-of-way. The legislation gave the PUC until <br />March 1, 1998, to adopt the new rules. In the absence of adopted rules, the legislation authorized <br />cities to adopt their own regulations. The PUC has notified the legislature they will be <br />requesting an extension until December 31, 1998, to promulgate the rules. Mr. Jankowski noted <br />that if Council introduces this ordinance and passes it, it will be effective only for this <br />construction season as there will probably be changes after the task force reviews it. <br /> <br />City Attorney Goodrich explained that there is no real urgency to get this ordinance adopted. We <br />do not jeopardize ourselves by not adopting this. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to table <br />introduction of the right-of-way ordinance. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer and <br />Zimmerman. Voting No: None. Absent: CouncilmemberBeahen. <br /> <br />Case #6: Update on Chapter 9.15 "Towers" City of Ramsey City Code <br /> <br />Zoning Administrator Frolik stated that Community Development Assistant Walther researched <br />information relating to Council's concern that the co-location of PCS providers on towers may <br />lead to a proliferation of utility buildings and accessory structures at the base of towers.
