of the opinion that intensifying the regulations for the design or number of utility building and <br />accessory structures at the base of the tower is not necessary because, due to the height limitation <br />set in the tower and antenna ordinance, the most we can expect to locate on any one tower is <br />three. <br /> <br />No action is required. <br /> <br />Case #7: Amendments to Chapter 9.11.02 Subdivision 12 City of Ramsey City Code <br /> <br />Zoning Administrator Frolik stated that staff and the Planning Commission have drafted an <br />ordinance to amend City Code regarding accessory structures. The ordinance would reduce the <br />threshold for metal buildings from 2.5 acres to 2.0 acres. It would also require that metal <br />buildings on parcels ranging in size from 2 to 4.9 acres be designed with soffit, fascia, and eaves. <br />In addition, that language that allows persons to exceed the single accessory structure size limit <br />by the difference between their principal garage and 864 square feet is being eliminated. This <br />language erodes the purpose of maximum single accessory structure size limits and allows for <br />larger buildings which foster illegal businesses. Now if these amendments are made, she <br />anticipated that the City Council will then be receiv/ng requests for conditional use permits to <br />utilize garage and accessory structure square footage allotments in one or two buildings versus <br />following the maximum accessory structure size limit. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to introduce the <br />proposed ordinance to amend Chapter 9.11.02, Subd. 12 (Accessory Buildings) of the City Code <br />to allow metal accessory structures on properties two acres and greater in size, and add design <br />standards for accessory structures on parcels two to five acres in size. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer and <br />Zimmerman. Voting No: None. Absent: CouncilmemberBeahen. <br /> <br />Case #8: Settlement of Makens/Royal Concrete Condemnation Action <br /> <br />City Attorney Goodrich stated that this case concerns a condemnation action. The Court- <br />appointed Commissioner awarded the land owner $7,100 in damages as a result of the City's <br />taking. The landowner had asked for an award of $31,000. The landowner has the right to <br />appeal the $7,100 award to District Court and have a jury trial but he is willing to fully settle the <br />case for $9,100, an additional $2,000 above the Commissioner's award. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to authorize <br />payment of $9,100 to L.W. Makens, Diana M. Makens and Royal Concrete Products, Inc. as and <br />for full and complete settlement of the City of Ramsey v. L.W. Makens et. al. condemnation <br />action, Anoka County District Court File No. C2-97-7193. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Beyer and Haas <br />Steffen. Voting No: None.
