Mr. Gruber added that they will more than likely cease outside activities at 6:00 p.m. on <br />Sundays. <br /> <br />Attorney Goodrich then recommended that Condition #10 relating to the Mississippi River <br />Bridge Crossing should read, the Permittee shall enter into an agreement with Anoka County for <br />an option to purchase the appropriate right-of-way for a potential Mississippi River Bridge <br />Crossing which would impact the site. He also suggested adding a condition to read: Permittee <br />shall not permit alcohol beverages to be consumed on the premises, which alcohol beverages are <br />not purchased on the premises. <br /> <br />Mr. Gruber stated they have no problem with that and added that they will not allow tailgating <br />parties in the parking lot. <br /> <br />Mr. Goodrich pointed out that the conditions will not include shorter hours for Sunday unless the <br />Council wants to go back and be more restrictive for the SuperBowl. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to adopt <br />Resolution #98-03-050 adopting Findings of Fact #0452 relating to the request for a conditional <br />use permit from Diamonds Sports Bar & Grill. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beahen, Beyer and <br />Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution #98-03-051 approving the issuance of a conditional use permit, as amended (as <br />recommended by City Attorney) to Diamonds Sports Bar & Grill, Inc. and declaring the terms as <br />proposed. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Case #9: <br /> <br />Request for Final Plat approval of the Diamonds, A Minor Subdivision; Case <br />of Gary Gruber and Jim Martin <br /> <br />City Engineer Jankowski stated that the minor subdivision entitled The Diamonds, consists of a <br />replat of Outlot C in Tooth Acres. The purpose is to replace the outlot designation on the subject <br />property with a lot and block number so that it will be eligible for a building permit; no new lots <br />are being created. The plat is 16.6 acres in size and consists of one lot and one outlot. The <br />purpose of the outlot is to preserve a corridor for the future extension of a highway frontage road, <br />Riverdale Drive. That outlot will be deeded to the City. <br /> <br />Councilmember Haas Steffen inquired about Traprock Street being on the MSA plan. <br /> <br />Gary Gruber, applicant, stated that originally Traprock was the road that was going to be <br />upgraded to MSA standards, however, the County has decided that is not what they want done. <br /> <br />City CounciFMarch 24, 1998 <br /> Page 10 of 18 <br /> <br /> <br />
