and land acquisition in exchange for tree preservation in order to protect and intensify the natural <br />screening between the heavy industrial uses on the east side of Unity Street and the light <br />industrial uses on the west side of Unity. He presented a draft agreement and requested <br />authorization from Council to enter into it. <br /> <br />Jim Lindberg, Attorney for Mr. Bjorklund, commented that the negotiations began back in 1995. <br />He hoped to come back to Council with a preliminary plat. <br /> <br />City Attorney Goodrich stated that the City will be selling 51,000 square feet to Bjorklund for <br />$1.00 per square foot. The City is obtaining an easement to preserve trees for screening purposes <br />to make this aesthetically pleasing. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to authorize <br />the Mayor and City Administrator to enter into the Development Agreement with Bjorklund <br />Ready Mix. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Beahen and Zimmerman. Voting <br />No: None. Absent: Councilmembers Beyer and Haas Steffen. <br /> <br />Case #6: <br /> <br />Consider Policy for Individual Requests to Grant an Exception to the <br />Moratorium Ordinance <br /> <br />City Attorney Goodrich stated that the City Council has asked staff to develop a policy for <br />individual requests for exception to the moratorium ordinance. The City has received roughly <br />six requests. In the previous cases, staff contacted the planner (Hoisington Koegler Group, Inc.) <br />to find out how to proceed. The planner has charged us for this service, so the City is proposing <br />a $250 escrow which would be refunded to the applicant if it is not all used. The planner's report <br />would be received by staff along with the application and then the applicant could decide <br />whether or not to proceed. If they determine they do not want to proceed, the process ends at this <br />point. If they determine they want to proceed, the application and report will be placed in front <br />of Council for a decision. <br /> <br />Discussion ensued relating to Ben Deemer's earlier request. If a property does not require <br />rezoning or replatting, you do not have to go through this process. Attorney Goodrich will <br />explore Mr. Deemer's issue further. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to adopt the <br />following Moratorium exception policy: 1) Each request for exception is to be reviewed by the <br />City's Consulting Comprehensive Planner for their recommendation; 2) Each request for <br />exception shall be accompanied by a $250 escrow deposit to be used for payment of the <br />Planner's charge to the City for their review and written report. Unused funds to be returned to <br />the applicant; 3) The Planner's report shall be reviewed by City staff with the applicant; and 4) <br />The applicant shall make the decision as to whether he/she desires to be placed on a City Council <br />agenda for formal consideration of the moratorium exception request. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Beahen and Zimmerman. Voting <br />No: None.
