Voting Yes: Mayor Gamec, Councilmembers Beahen and Haas Steffen. <br />Voting No: Councilmember Zimmerman. Absent: Councilmember Beyer. <br /> <br />Case #5: <br /> <br />Request for Final Plat Approval of Apple Ridge 5th Addition; Case of <br />Oakwood Land Development, Inc. <br /> <br />Zoning Administrator Frolik stated that Apple Ridge 5th and final Addition consists of 30 <br />lots. Access to this phase will also be from T.H. #47, which is intended to be in place <br />until north/south streets within the plat are extended outside the plat to funnel traffic <br />north to 160th or south to 156th. Development of this final phase will also open up 157th <br />and 158th Lanes to the west for access to C.S.A.H. #5. Residents of Halls Dover Acres <br />had previously requested that Council order a lead link closure between their <br />neighborhood and Apple Ridge. The Development Agreement has been drafted with a <br />provision for a closure in the event Council approves it. If not, the provision for a closure <br />will be eliminated. She explained that all of the lots exceed the 10,800 square foot <br />minimum area requirement, and the lots along the west boundary of the plat have been <br />designed so as not to exceed the established density of the adjacent rural residential lots. <br />The development agreement has been drafted to prohibit re-subdivision of these lots until <br />such time as the adjacent rural lots re-subdivide to a lesser density. The standard <br />drainage and utility easements have been provided around the perimeter of the lots. Park <br />dedication is recommended in cash which will potentially be utilized to acquire property <br />in the area for a neighborhood/community park. <br /> <br />City Attorney Goodrich pointed out that the neighbors adjacent to the lots have asked that <br />these lots be unable to subdivide until they are able to also. The covenants will be <br />regarding Lots 1 through 4 of Block 1. The language states that Lots 1, 2, 3, and 4 of <br />Block 1, and Lot 1 of Block 3 shall not be considered for re-subdivision until adjacent <br />parcels to the west are re-platted to a lesser density and this restriction shall be in the <br />form of a restrictive covenants. He suggested that the language may need some "tidying <br />up" - maybe it should be more specific than "re-platted to a lesser density". The intent <br />has been presented and it will be recorded that way but he asked for authority to make the <br />language more specific. <br /> <br />Mayor Gamec stated that they would have to remain at these large lot sizes forever the <br />way the Charter is written. <br /> <br />Ms. Frolik read a letter from Mr. Charles Johnson, 6010 - 159th Lane NW, who was <br />unable to be present for the meeting, but wanted to have input on placing a barrier on <br />158th. In his letter, he noted other neighborhoods the Council are trying to assist with <br />traffic problems - speeding and heavy traffic.
