Mr. Peterson stated he is surprised by this discussion. This final plat is what was <br />approved at the preliminary plat stage. Our role tonight is to confirm that this is <br />substantially what the final plat is. This is what was submitted and what was approved. <br /> <br />Mayor Gamec stated that, in his opinion, the best thing would be to not have any type of <br />barrier between the neighborhoods, however, if there has to be something, he felt that the <br />gate would be the better idea. <br /> <br />Upon inquiry, Mr. Peterson answered that the road will not be in until the fifth phase is in <br />- that will be the first time traffic will be able to move from east to west. People living in <br />Phases 1, 2, 3 and 4, would be forced to go east until the fifth addition is platted. <br /> <br />Mayor Gamec stated that, in most cases, he would favor the developer paying for <br />something like this, however, in this case, he wasn't sure who should pay. <br /> <br />Councilmember Beahen felt that the developer should not have to pay for this - the City <br />should fund it. <br /> <br />Councilmember Haas Steffen felt that the City should erect and pay for the barrier arm. <br /> <br />Councilmember Zimmerman suggested that the developer should have to pay for this <br />barrier. He felt it would be unfair for all the taxpayers to pay for something that would <br />benefit few. <br /> <br />Mr. Peterson stated he would have no problem paying for the purchase of the arm barrier. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to <br />direct the Public Works Department to install a gate to impede traffic except for <br />emergency vehicles at the intersection of 158th Avenue and Potassium Street in the <br />Apple Ridge 5th Addition, which installation shall be at such time as said 158th is <br />accepted for use by the City. <br /> <br />Further discussion: Director of Public Works Kapler asked to have input in the design of <br />the barrier. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen and Beahen. <br />Voting No: Councilmember Zimmerman. Absent: Councilmember Beyer. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to <br />amend the development agreement to read that the developer shall deposit with the City a <br />non-refundable sum of $1,500 to defray the City's expense of installing a gate at the <br />intersection of 158th Avenue and Potassium Street in the Apple Ridge subdivision. <br /> <br />Further discussion: It was noted that the City would cover the costs of repair/replacement <br />of the barrier. <br /> <br />City CounciifMay 12, 1998 <br /> Page 9 of 16 <br /> <br /> <br />
