Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen and Beahen. <br />Voting No: Councilmember Zimmerman. Absent: Councilmember Beyer. <br /> <br />Terry Hendriksen, 15631 Ramsey Boulevard NW, Ramsey, pointed out that the City is <br />intending to connect the new streets to existing streets outside of the plat. He inquired if <br />a traffic study has been done. <br /> <br />City Attorney Goodrich stated that a traffic study was done in March, 1997. <br /> <br />Mr. Hendriksen expressed concern that a traffic generation analysis as articulated in the <br />Charter has not been done. <br /> <br />Attomey Goodrich replied that in October 1997, the Council determined that the Charter <br />provision was not applicable to Apple Ridge because of its unconstitutional retroactive <br />application. <br /> <br />Mr. Hendriksen felt that the City is not following what is required in the Charter and <br />mentioned the traffic issue on 149th Avenue and the traffic issue for Halls Dover <br />residents. <br /> <br />Attorney Goodrich stated that the Charter provision relates only to new plats and because <br />Halls Dover is not a new platting process, the City could undertake whatever traffic <br />calming program it deems appropriate, not withstanding Charter provision 14.2.2. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to <br />approve the development agreement as amended. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen and Beahen. <br />Voting No: Councilmember Zimmerman. Absent: Councilmember Beyer. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to <br />adopt Resolution #98-05-091 granting final plat approval to Apple Ridge 5th Addition. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen and Beahen. <br />Voting No: Councilmember Zimmerman. Absent: Councilmember Beyer. <br /> <br />Case #6: Youth Access to Tobacco Ordinance Compliance Issues <br /> <br />Police Chief Gustafson stated that the City's Youth Access to Tobacco Ordinance became <br />effective in February, 1998. Such ordinance provides for mandatory compliance checks, <br />one of which was conducted on April 30, 1998. Under direction of the Police <br />Department, a minor attempted to purchase a tobacco product. All 18 of the City's <br />tobacco licensees were checked. Four of them allowed the minor to purchase a tobaceo <br />product. In each case, the licensee's employee selling the tobacco product was an adult. <br />Each of the selling employees who the City alleges violated the ordinance was notified of <br />the violation at the time of the occurrence.
