The CUP has been drafted to emphasize that Mr. Groothosen may park and <br />store his commercial vehicles and equipment at his home, but that does not give him the <br />right to conduct commercial activity in the building. The Planning Commission <br />conducted a public hearing and there were no negative verbal or written comments <br />submitted. The Planning Commission recommended approval of the request based on the <br />fact that the use eliminates a blighted condition and provides a way to come into <br />compliance with City Code regarding the parking and storing of commercial vehicles and <br />equipment in the Residential District. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution//98-05-104 adopting Findings of Fact//0456 relating to a request from Kevin <br />and Mary Groothosen for a Conditional Use Permit to exceed the total accessory structure <br />space and the maximum single accessory structure size allowed on parcels three acres in <br />size. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer and <br />Zimmerman. Voting No: None. Absent: CouncilmemberBeahen. <br /> <br />Councilmember Haas Steffen asked that a condition be added that says the blighted <br />structure will be removed within 60 days of occupancy of the new building or of final <br />inspection. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution//98-05-105 approving the issuance of a Conditional use Permit, as amended, <br />based on Findings of Fact//0456 and declaring terms of permit for an overage in total <br />garage and accessory building space and single accessory structure size restrictions. <br /> <br />Motion carried. Absent: CouncilmemberBeahen. <br /> <br />Case #3: <br /> <br />Request for Site Plan Approval; Case of Rademacher Companies and <br />Bill's Superette <br /> <br />Zoning Administrator Frolik stated that Rademacher Companies has submitted a site plan <br />for the development of an 8,000 square foot convenience store including gas sales and a <br />2,160 square foot car wash at the intersection of T.H.//47 and 153rd Avenue. The access <br />from T.H. //47 will be a northbound right-in only and, by mutual agreement of the <br />developer and the City, will be abandoned when 153rd and//47 is signalized. Three <br />accesses are proposed from 153rd Avenue which is acceptable to the City Engineer. The <br />project is proposed to be served by sanitary sewer and municipal water. The utility plans <br />show extending the services through the medical clinic property and agreements need to <br />be in place before this can happen. The building locations exceed all of the setbacks from <br />property line requirements.
