to the Charter Commission for its review and comment. <br /> <br />Motion Carded. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen, and <br />Councilmember Zimmerman. Voting No: None. <br /> <br />City Attorney Goodrich announced that the Charter Commission has scheduled a meeting to <br />address this specific issue on June 15, 1998, 6:30 p.m., at the City Hall. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to direct staff <br />to negotiate with Hoisington Koegler to address ordinances as indicated and to direct City <br />Attorney Goodrich to inventory what is in the charter and ordinances to protect residents from <br />being forced to connect to sewer and water. <br /> <br />Mayor Gamec concurred that the key issue is to remove the fear of residents about being forced <br />to connect to sewer. <br /> <br />Motion Carded. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beahen, Beyer, and <br />Zimmerman. Voting No: None. <br /> <br />Councilmember Haas Steffen noted there is to be more review of Charter amendments. <br /> <br />City Attorney Goodrich stated this is correct and they have investigated the third Charter <br />amendment dealing with density. Their opinion is drafted but not yet presented to the Council <br />due to the pending law suit. <br /> <br />Case #7: <br /> <br />Request for Expansion of Metropolitan Urban Service Area; Case of Dolphin <br />Real Estate Partnership <br /> <br />City Administrator Norman explained this request needs to be reviewed by the Planning <br />Commission but they will need some direction from the Council due to the charter amendment <br />language. He suggested the request be referred to the Planning Commission with the direction <br />that they review it focusing on the normal planning process had Chapter 14.1.3 not existed. <br /> <br />Zoning Administrator Frolik advised that will require a public hearing by the Planning <br />Commission <br /> <br />Mayor Gamec explained that this request involves Burger King and after they met all of the <br />criteria they are not be able to go ahead and open at that site unless they connect to sewer and <br />water. <br /> <br />City Administrator Norman restated the need to provide direction to the Planning Commission to <br />make their consideration as if Section 14.1.3 does not exist. <br /> <br />City Attorney Goodrich advised that if followed or not followed, the Charter amendment still <br />needs the Planning Commission recommendation because it would result in an amendment. <br /> <br />City Council/June 9, 1998 <br />Page 19 of 27 <br /> <br /> <br />
