Voting No: None. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution #98-06-132 approving the issuance of a conditional use permit based on <br />Findings of Fact #0459 and declaring terms of permit for an overage in total garage and <br />accessory building space and single accessory structure size restrictions. The conditional <br />use permit will be amended to state that the applicant acknowledges the impact this <br />structure will have to future subdividing or sale of property. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #8: <br /> <br />Request for a Conditional Use Permit for a Private Dog Kennel to <br />Maintain more than Two Adult Dogs on a Parcel: Case of Phillip and <br />Frances Teetzel <br /> <br />Zoning Administrator Frolik stated that the City received an application from Phillip and <br />Frances Teetzel for a conditional use permit to maintain a maximum of four adult dogs on <br />the property at 16405 Quartz Street NW. The Teetzel's property is approximately one <br />acre in size and is zoned R-1 Rural Residential. The site plan provided indicates that the <br />east and south yards are fenced in to provide a secured exercise area for the dogs. The <br />dogs are raised as indoor dogs and will sleep indoors. However, in the event the <br />applicants decide to build an outdoor kennel structure, the permit has been drafted to <br />require that it be at least 75 feet from any common property lines with adjacent <br />neighbors. Ms. Frolik informed Council that the Planning Commission conducted a <br />public hearing on June 2. They received one letter in support and two letters in <br />opposition of the Teetzel's request. In response to a comment that passers-by provoke <br />the Teetzel dogs to bark by kicking the fence, Mr. Teetzel offered to add another fence <br />line to the property that will keep the dogs further away from the front yard. <br /> <br />Phillip Teetzel, 16405 Quartz Street NW, Ramsey, reported that he is moving the fence <br />back so it will be 160 feet from the street rather than 40 feet from the street. <br /> <br />Councilmember Haas Steffen inquired if a license for a kennel were granted and the City <br />received numerous complaints, could the license be pulled? <br /> <br />Attorney Goodrich replied that the City would be granting a conditional use permit which <br />will have conditions listed. If the conditions are violated, the Council has the ability to <br />evoke the permit. It would require a public hearing and notice. <br /> <br />Councilmember Haas Steffen suggested that it is possible a complaint may not be <br />legitimate to which Mr. Goodrich responded that the complaints are investigated by City <br />staff.
