Absent: Councilmembers Beyer and Haas Steffen. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to <br />adopt Resolution #98-07-163 approving the issuance of a conditional use permit based on <br />Findings of Fact #0464 and declaring terms of permit to grade and export soils. <br /> <br />Motion carded. Absent: Councilmembers Beyer and Haas Steffen. <br /> <br />Case #5: <br /> <br />Request for a Conditional Use Permit to Grade and Import Soils; <br />Case of North Fork, Inc. <br /> <br />Zoning Administrator Frolik stated that North Fork, Inc. submitted an application for a <br />conditional use permit to grade two sites in the Northfork subdivision. Site A is Lots 7 <br />and 8 of Northfork and Site B is Lots 5, 6, 7 and 8 of the Northfork Links Addition. The <br />proposal for Site A is to re-grade the lots to accommodate walk-out style homes. The <br />proposal for Site B is to complete the grading and importing of soils to achieve elevations <br />approved in the grading plan associated with a conditional use permit issued in 1995, that <br />has now expired. Ms. Frolik reported that the grading of Site A entails placing the <br />foundation for each of the two future homes at the existing grade and building up the <br />grade from four to six feet surrounding the front of the structure. At the Planning <br />Commission meeting, the owner of the adjacent property to the west was present and had <br />drainage concerns. Subsequent to that meeting, Dennis Peck has submitted a revised plan <br />which is subject to the City Engineer's approval. With regard to Site B, the chief concern <br />at the public hearing was the impact caused during the interval while re-vegetation was <br />occurring. Staff is recommending approval of the requests contingent upon approval of <br />the City Engineer favorably reviewing the revised grading plan for Site A and that Site B <br />be allowed to be graded according to plan, but only in conjunction with the construction <br />of the residences on these lots. <br /> <br />Dennis Peck was present and described the sites and the work involved. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to <br />adopt Resolution #98-07-164 adopting Findings of Fact #0465 relating to North Fork's <br />request for a Conditional use Permit to grade and import soils in Northfork and Northfork <br />Links. <br /> <br />City Council/July 28, 1998 <br /> Page 8 of 17 <br /> <br /> <br />
