Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beahen and Zimmerman. Voting No: None. Absent: Councilmembers Beyer and Haas Steffen. Motion by Coun¢ilmember Beahen and seconded by Councilmember Zimmerman to a adopt Resolution #98-07-165 approving the issuance of a Conditional Use Permit based on Findings of fact #0465 and declaring terms of permit to grade and import soils. Case #6: Request to Place Business Identification Sign on City Property; Case of Diamonds Sports Bar and Grill Zoning Administrator Frolik stated that the developers of the Diamonds Sports Bar and Grill have applied for a sign permit for a free-standing ground sign that is in compliance with City Code. However, because of their obligation in platting The Diamonds, they have deeded their highway frontage to the City as Outlot A for the possible future extension of Riverdale Drive. The literal interpretation of the sign ordinance would require them to place their sign on the south side of Outlot A or more than 80 feet back from the highway right-of-way. Gary Gruber is requesting the City's permission to place the sign on Outlot A, adjacent to the highway, until such time as Riverdale is constructed. The lease agreement will clearly spell out that at such time the City decides to construct Riverdale Drive, it will be the obligation of Diamonds Sports Bar and Grill to move the sign. Ms. Frolik noted that because of the cooperation demonstrated by Mr. Gruber during the platting of The Diamonds to work with the City and the County to preserve a Mississippi River bridge corridor and a highway frontage road, staff is recommending approval of the request to place the sign on Outlot A. Councilmember Zimmerman inquired if this would be a $1 lease type of agreement. City Attorney Goodrich suggested $10 a year for 10 years unless the City chooses to give the 90 day notice to cancel. The sign would be moved at the owners expense. Gary Gruber stated that he was told the rent would be $1. Mayor Gamec stated that the City has been receiving a few requests for signs off of the business premises. He wondered how approval of this sign would affect other requests. Ms. Frolik reminded Mayor and Council that the developers of The Diamonds would have owned this property if they had not been asked to deed it to the City. Councilmember Zimmerman stated that if the sign would have to be put on The Diamonds property it would be so far back from the road. City Council/July 28, 1998 Page 9 of 17
