Absent: Councilmembers Beyer and Haas Steffen. <br /> <br />Motion by Coun¢ilmember Beahen and seconded by Councilmember Zimmerman to a <br />adopt Resolution #98-07-165 approving the issuance of a Conditional Use Permit based <br />on Findings of fact #0465 and declaring terms of permit to grade and import soils. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beahen and Zimmerman. <br />Voting No: None. Absent: Councilmembers Beyer and Haas Steffen. <br /> <br />Case #6: <br /> <br />Request to Place Business Identification Sign on City Property; Case <br />of Diamonds Sports Bar and Grill <br /> <br />Zoning Administrator Frolik stated that the developers of the Diamonds Sports Bar and <br />Grill have applied for a sign permit for a free-standing ground sign that is in compliance <br />with City Code. However, because of their obligation in platting The Diamonds, they <br />have deeded their highway frontage to the City as Outlot A for the possible future <br />extension of Riverdale Drive. The literal interpretation of the sign ordinance would <br />require them to place their sign on the south side of Outlot A or more than 80 feet back <br />from the highway right-of-way. Gary Gruber is requesting the City's permission to place <br />the sign on Outlot A, adjacent to the highway, until such time as Riverdale is constructed. <br />The lease agreement will clearly spell out that at such time the City decides to construct <br />Riverdale Drive, it will be the obligation of Diamonds Sports Bar and Grill to move the <br />sign. Ms. Frolik noted that because of the cooperation demonstrated by Mr. Gruber <br />during the platting of The Diamonds to work with the City and the County to preserve a <br />Mississippi River bridge corridor and a highway frontage road, staff is recommending <br />approval of the request to place the sign on Outlot A. <br /> <br />Councilmember Zimmerman inquired if this would be a $1 lease type of agreement. <br /> <br />City Attorney Goodrich suggested $10 a year for 10 years unless the City chooses to give <br />the 90 day notice to cancel. The sign would be moved at the owners expense. <br /> <br />Gary Gruber stated that he was told the rent would be $1. <br /> <br />Mayor Gamec stated that the City has been receiving a few requests for signs off of the <br />business premises. He wondered how approval of this sign would affect other requests. <br /> <br />Ms. Frolik reminded Mayor and Council that the developers of The Diamonds would <br />have owned this property if they had not been asked to deed it to the City. <br /> <br />Councilmember Zimmerman stated that if the sign would have to be put on The <br />Diamonds property it would be so far back from the road. <br /> <br />City Council/July 28, 1998 <br /> Page 9 of 17 <br /> <br /> <br />
