City Attorney has reviewed the proposed permit and recommended that the fourth term <br />be amended to include language that one of the options for violating the terms would be <br />to revoke the permit. <br /> <br />Councilmember Haas Steffen mentioned that the City Council has had discussion about <br />holding compliance hearings. <br /> <br />City Attorney Goodrich stated that he has been gathering information on that issue. <br /> <br />Doni Heule stated that all the dogs but one old one have been debarked. The buffer fence <br />is in and it measures about 60 feet to the east side of their property. They are ready to <br />proceed on the privacy fence and she added that the exercise area is very secluded. She <br />reiterated that they raise show dogs that are imported from Europe and they are <br />maintained for as valuable as they are. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />resolution #98-08-208 adopting Findings of Fact #0469 relating to Mark and Doni <br />Heule's request for a conditional use permit for a private dog kennel for a maximum of <br />eight dogs. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer and <br />Beahen. Voting No: None. Absent: CouncilmemberZimmerman. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Haas Steffen to adopt <br />Resolution #98-08-209 approving the issuance of a conditional use permit based on <br />Findings of Fact #0469 and declaring terms of permit for private dog kennel to maintain <br />more than two dogs on a parcel of land with the added language to term #4 that reads one <br />of the options for violating the terms would be to revoke the permit. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beyer, Haas Steffen, and <br />Beahen. Voting No: None. Absent: CouncilmemberZimmerman. <br /> <br />Case #7: <br /> <br />Request for a Conditional Use Permit for a Private Dog Kennel to <br />Maintain More Than Two Adult Dogs on a Parcel; Case of Douglas <br />and Evelyn Behrens <br /> <br />Zoning Administrator Frolik reported that Doug and Evelyn Behrens recently purchased <br />the property at 5759 - 153rd Avenue NW and are requesting a conditional use permit to <br />maintain a maximum of 15 adult dogs and puppies. The subject property is <br />approximately five acres in size and is zoned R-1 Rural Residential. The surrounding <br />parcels are zoned R-1 Rural Residential and B-1 Business. The applicants breed and <br />show Shiba Inus, a small companion dog. They generally have four our five adult dogs at <br />any given time and average two litters a year with each litter producing three to four <br />puppies. The puppies are offered for sale at the age of eight weeks.
