Absent: CouncilmemberZimmerman. <br /> <br />Case #5: <br /> <br />Request for a Conditional Use Permit to Grade Soils; Case of Ronald <br />Kabat <br /> <br />It was noted that there was no in the audience specifically for the discussion on this case, <br />and there were for other cases, thus Councilmember Haas Steffen suggested going on to <br />the next case and coming back to this one later in the meeting. <br /> <br />Case #6: <br /> <br />Request for a Conditional Use Permit for a Private Dog Kennel to <br />Maintain More Than Two Adult Dogs on a Parcel; Case of Mark and <br />Doni Heule <br /> <br />Zoning Administrator Frolik stated that the City received an application from Mark and <br />Doni Heule for a conditional use permit to maintain a maximum of eight (8) adult dogs <br />on the property at 7262 - 162nd Lane NW. She reported that the subject property is <br />approximately 3.9 acres in size and is zoned R-1 Rural Residential. The applicants have <br />provided a site plan and text which indicates that they raise show dogs that reside in the <br />home and are only let outdoors for exercise in a two-acre fenced yard. The dogs are not <br />outdoors when no one is home, most of them have been surgically debarked, and <br />generally, there are only six on the property at any given time as two of the eight are <br />usually with the handler in Texas. Ms. Frolik noted that in addition to the existing fenced <br />exercise yard, the Heule's proposed to install a privacy fence along the northwest comer <br />and east line of the existing fence line to provide screening in addition to containment <br />from the public road and adjacent neighbors to the east. The applicants are a veterinarian <br />and veterinarian technician by profession. The Planning Commission conducted a public <br />hearing on July 7, and the adjacent neighbors to the east expressed opposition to the <br />request.
